US visa waiver after rejection experiences?

Hi all, I have a criminal record from approximately 8 years ago. I knew I would not be eligible for ETSA so I applied for a tourist visa instead in the hopes I could attend an event in America in January. The visa was rejected but the consular officer applied for a waiver of that ineligibility. They told me it could take months for that to be reviewed in Washington and I haven't heard anything yet.
