    Hi all,
    I am having a problem with my mother’s visitor VISA and need your advice on the same. My mother had her appointment in US consulate for Visitor VISA on Monday, 14th Feb 2005. She didn’t get through the interview at the Chennai consulate, India. Her VISA was rejected under section 214b

    My mother had all the paperwork ready with her, but the immigration officer didn’t go through any of these. They just checked for her passport and DS 156 form. She was just asked 5 questions and then her visa was denied. My mother was working for a private firm but she is no longer working now and I am sponsoring her visa. When I applied for her interview, my only brother was in Chennai. But when she took the interview, my brother was here in US. She was asked the questions like:

    Q: When did your husband expire?
    My mother: he expired in Aug, 1997

    Q: how many brothers and sisters you have
    My mother: I have 3 sisters and 2 brothers. All of them are in Kerala, India.

    Q: how many brother sisters does your husband have?
    My mother: I have 2 sisters in law and 1 brother in law. All of them are in Kerala, India.

    Q; Do you have any other siblings
    My mother: I have a son who is settled in Chennai

    Q: Are you house wife
    My mother: yes

    Q: But you have mentioned in your DS 156 that you are retired.
    My mother: Since I am aged, I put it as ‘retired’

    With this they didn’t ask anything more and rejected her VISA. Initially I thought they rejected because of the discrepancy in what she said and what is in DS156. But then her VISA was rejected under section 214B. I am here on a deputation for a project with Microsoft and my stay here is confirmed only till August, I badly want to bring my mother here and show her these places. My mother is having financial proof in India, but seems like the consulate officer didn’t look into any of the documents.

    I have rescheduled for an appointment and I have got her appointment on June 15, 2005.
    Q1. Can I advance my mother's appointment since I have to go back by august? Do you think a time gap of 4 months will help when she re-applies?

    Q2: Do you think the visa got rejected because my mother said that my brother is in Chennai. She said so when I applied for interview, my brother was in Chennai and at the time of interview my mother didn’t have much documents to showcase to the officer.

    Q3: There is no much change in the circumstances. In addition my brother has now come to US (Boston) with his wife. Do you think I should send the documents from my brother also for my mother’s interview? Or should she not talk about that.

    Do you have any idea on what I need to do to convince the consulate about her strong ties in India? Is there any best way to convince consulate that she ***’t planning to stay here in US permanently and just visiting us for few months? What all precautions should be taken for her to appear for the interview again? Can we schedule an appointment in consulates other than chennai to get an earlier date. How risky it is to go for an earlier date. I am worried because my current assignments gets over by august.

    immihelp, please guide me. I am totally confused and worried

    1. There is no easy way other than to keep trying on TTS site for earlier appointment.

    2. I don't think so. It may be because of 'Retired' vs. 'Housewife'.

    3. She should carry proof of legal stay of your brother in US.
