  • Parents visa about to expire, need to visit

    My parents were granted 5 years visa for thier first attempt and they have visited US twice during this period. The visa is about to expire in another 4 months. Would like to know -

    1. Can they visit US before the visa expires now and stay upto 6 months? Would it be possible to apply for extension after they arrive in US and before the expiry date? Would they even be granted 6 months at immigration?

    2. Can they go for another visa stamping appointment now while the current visa is still active?

    This may not be their last visit and they might come in future too. Given the above situations, if answer for both is yes, is #1 / #2 better?

    Visa only needs to be valid on the day of entry. They can be given an I-94 which is longer than Visa expiry. Extension of stay beyond 6 months are very very rarely granted.
    If they have time, they should try to get their Visas renewed. Their past record of returning to home country beforE I-94 will be useful.

      Thanks for the response. So a stay beyond visa expiry but within 6 months is a possibility? My parents have returned within the granted period in the past.

          passport expired, visa about to expire in a week

          hello,

          my parents visa expires in anther week and we noticed late that their passport expired more than 6 months ago. If they were to come to US now, is the only alternative to get a new passport and then get a new visa appt?

          if new visa has to be obtained, while we are trying for the new passport and the wait period, can they pay the visa fees at HDFC bank and get the appointment for interview using the expired passport no.? Can this be overwritten with new passport no. by the time they appear for the interview or travel to US? Please suggest on the best way to get them to the US sooner.
          would like to know which stage is an unexpired passport a must, is it only during travel or during visa interview or right from HDFC bank payment or visa appointment?

              Thank you for response. I somehow thought of information somewhere on immihelp.com that says a HDFC DD and appointment can be taken with expired passport and the new passport no. can be overwritten at the time of interview.

              I am not able to trace it as of not, are you saying it is a absolute must to wait for new passport?
