  • B2 stay period what is correct 180 days or 6 months

    Can any expert please help, below is I-94 detail. A visitor entered USA on 25th May 2023 and was given admit until 24 Nov 2023, by the immigration officer at port of entry. Same date is on the I94 record in CBP website.

    Person followed the rule and left USA on 24th Nov 2023.

    Is there any overstay in this case considering it was visitor visa entry, which he have 6 month or 180 day to stay.
    If you calculate days between entry and exit then it will be 184 days. Immigration officer at port of entry decided the exit date, if one stay till the given date and it is beyond 180 days then it breaks any rule?


    Most Recent Date of Entry: 25 May 2023
    Class of Admission : B2
    Admit Until Date: 11/24/2023​

    If the officer admitted them until that date, then they can stay until that date. Technically, the regulations say that B2 can be admitted for up to 1 year.

      Thank you! I just applied immigration application and was worried if this will be considered as overstay? Because in the system it will show as over 180 days, don’t know what counsel see overseas in there system, whether they can see the immigration officer at port of entry permitted this.
