    Hi All

    I have my parents here on B1/B2 visitor, and their I94 says they can stay here till Feb 17th. Unfortunately my Dad's passport got expired on 3rd Jan 2011. We were unaware of it. Their returned flight was on 31st Jan but Air India refused their travel because of dad's expired visa.

    Now we have an appointment on 3rd Feb, for his passport renewal at Indian Consulate New York. If passport process is delayed and if they cant make it by Feb 17th, what would happen? Do I need to file his extension? Even if I file extension but if USCIS delays in decision and it passes Feb 17th what would happen?

    Please do let me know as this is emergency and I am very much unsure what is going to happen now.

    In that case, you will need to file for their visitors visa extension.

    As long as you filed for an extension before Feb 17, you are fine.

      Passport expiry & renewal

      Hi

      Can you please say how you handled this situation? I have my mom here whose passport is expiring Dec and she is scheduled to leave Jan. I94 is till dec only. I need to apply for renewal of passport first. How long does it take? Did you go in person to NY? What documents did you take ? Can I get her renewal soon so I can apply for her extension too?

      Let me know your experience.

        In this case, even if she gets the passport renewed, she must leave before the I-94 date. She may file an extension but the decision won't be received before January. It will be better if she leaves before her current I-94 date and gets the passport renewed back in her home country.
