Visitor visa with petition

I have a petition filed by my uncle for my mother. I am over 25 years old and probably not eligible for petition anymore. I wish to visit USA with my family. My father works in a reputed company for last 12 years. I am also working as a doctor since last 4 months. We are planning to apply together for visitor visa. Will my petition affect our application even though I am over 25 years old??

Technically, you never had a petition for you, your mother has. And now, you are not even eligible as the derivative beneficiary. Therefore, that should not be a problem.

Does that mean If a VO ask " Do you have an immigrant petition ?" , i should say no???
Or should I say I have a petition but I am not eligible??
