  • Stay with B1/B2 Visa in USA

Person coming to USA on B1/B2 how long can he stay ?
    1. Uptil the date on the I94 ?
    2. Or that was mentioned in the invitation letter.

I-94 date is the legal doc

The date on I-94 is the legal limit of stay. The invitation letter doesn't have any meaning in this context.

      Invitation Letter

      1. If Invitation Letter does not carry any meaning then is that just a part of the formality ?

      2. Can the person be questioned for the next time if he travels Y was the earlier stay extended when the earlier invitation letter mentions 10-12 week of time ?

      3. Do u feel there would be any trouble coming to US next time ?

As I mentioned invitation letter is meaningless in the 'context' you are asking your question about, ie. duration of stay. Letter of invitation, though not a legal document, is very much applicable when you are applying for your visa.

However once you enter US, the date stamped on your I-94 is the legal limit of your stay.

Im stuck and need help & advice fast please

Hi , I'm new at this so I don't really know if its going to help me or not but here goes. I am from Australia and my daughters and I came to the USA in Feb on visitors visas. These expire next month and our return tickets have also expired already. My fiance's divorce has been delayed and will not be final for another 3 months, so obviously we can't get married till then. I can apply for an extension BUT!!!!!! I now have no proof of returning to Australia and not enough money to get more tickets back there. Has anyone got any other suggestions for me.

anantgok, it should not be problem since as explained in my earlier reply to you, invitation letter is not a legal document.

However I can think if immihelp will reply, you will be satisfied more.

My uncle came from India on B1/B2. On his I-94 there is no mention of 'end date' of his stay. Is this a mistake? Why I-94 does not have a date till which he can stay? Only thing is on the I-94 is his date of arrival. Should he do something about it? Is there a default duration?
                Thanks

If there is no expiry date mentioned in the I 94, do not stay beyond 6 months.
