  • B1/B2 issue!

Ok ladies and gentlemen, I need a little help here... For the past year my wife(Mexican) and I (US Citizen) have been crossing the border in the Sentri line without any issues. However, over the last week and half each time we cross we have been getting harassed by the CBP agents at the San Yedrio, CA crossing. On Friday (5 Aug @ 9:00pm) things really hit the fan with my wife and I. We just happen to get the one person that was out to save the world, and she really wanted to investaged if we were crossing legally. We have been in the process of getting my wife’s CR1 visa since Jun 2010 and are so close to finishing all of the required paper work before her interview appointment. The lady at the border crossing was trying to tell me that because the I-130 was approved that made my wife a prospective immigrant and that it canceled out her B1/B2 visa. After waiting in secondary inspection for almost 2hours with the possibility of my wife being deported and having her Sentri card and B1/B2 VISA taken away. They came back stating that we were good to go... The reason why I’m posting here is because, was the women right that her tourist status has been changed to possible immigrant and that her B1/B2 is no longer valid? I think the only reason why we were allowed to go is because a lot of the officers that work at that crossing are prior military and sided in my favor over the one woman, which is a huge possibility.

Visitor Visa does not allow immigrant intent and I-130 shows that she has immigrant intent. So the CBP officers are right. It is a favor that they even allowed her to enter.
This is my opinion and not legal advice.
