F2 VISA rejected, need suggestions.

  • F2 VISA rejected, need suggestions.

    Hi Guys!!

    My husband is studying in USA on F1 VISA. I applied for F2 VISA and it is rejected. I carried all the required documents, however VO didn't ask for any documents. I was the first one in a lot. Below are the questions that VO asked:

    VO: Good morning Ma'am.
    I: Good Morning.

    VO: Which VISA you are applying for?
    I: I am applying for F2 dependent VISA.

    VO: What your husband is studying?
    I: My husband is doing his ABC from XYZ college.

    VO: What is the course duration? how much he has completed?
    I: The course is four x years. He has completed one year and currently doing internship. After the course he is planning to come back to India.

    VO: Where is he?
    I: He is working xyz company in xyz city, state(clg is in diff state so I specified his current add).

    VO: What do you do?
    I: I am working in xyz company as xyz.

    VO: What is your annual package?
    I: My annual package is xyz.

    VO: How long have been you married?
    I: Its x years now.

    VO: Have you ever applied for USA VISA?
    I: Yes. I applied for F1 VISA four years back.

    VO: Was it approved?
    I: No. It was not approved due to xyz reasons.

    VO: Why you want to go to USA?
    I: I want to stay with my husband. I am planning to take a break from my career and stay with my husband till he completes his studies. after that we are planning to came back to India.

    VO: Sorry, your VISA is not approved. Thank you.
    I: Thank you.

    She didn't tell any reason for rejection. can you please suggest what is wrong in the above answers. I have given all ans fairly.

    I am planning to re-apply for F2. Any help will be appreciated. Thank you!!

    What school and program is your spouse attending?
    Unfortunately your previous F1 denial and not this F2 denial will affect your subsequent F2 application.
    This is my opinion and not legal advice.

        To analyze, you need to post

        1. reasons for F1 denial 4 yrs ago.
        2. How long have you been married?
        3. Are your current job and annual package very respectable?

          Hi, answers to those questions are as follows:
          1: 4 years ago my F1 got rejected because one of the financial document was not in English.
          2: I have been married since 2009
          3: Yes the job and salaries are respectable

            You were denied because the officer wondered why you were leaving a well paying job
            to join your husband who is not earning and you won't be earning on F2 either.
            The officer thought you must have a work opportunity lined up in US to stay for ever in US, so you are taking the big step of leaving a very good job in India.
            And the fact that you waited an year to apply for an F2, and an earlier F1 denial were other negatives.

              Thank You peace999! This seems to be the reason.

              Well I have another doubt related to my next move.I again want to apply for a VISA as I want to be there during the graduation ceremony of my husband to be held in May 2012. My options are
              1. Try again for F2. My husband's OPT will be valid till May 2013.
              2. Apply for visitor visa.

              Which one do you think would be less risky given that I already have two visa rejects.

              On a side note, my husband has a job and his company would be applying for H1B in April and he should have his H1B done by Aug-Sept.

              Given all these factors and understanding that later I will be applying for H4, which VISA makes more sense to you?

              Its a complicated equation; please let me know if I have not made myself clear.

                Actually I did misunderstand you before. You wrote in the interview post that husband's course
                is four x years . I thought it was 4 years.

                H1 and H4 visas do not require you to prove a non-immigrant intent like B1/B2 and F1 , F2.visas. For an H-4 they won't ask you questions to determine if you will come back. So, H4 should not be a problem at all, if all your paperwork is in order. Previous denials of visitor and student visas per se also do not affect H1 and H4.

                Visitor and F2s in your case will be difficult in view of your previous denials.
                I suggest you go for the H-4 once he gets his H-1b.
