  • Sponsoring In-Laws - Spouse Birth Certificate Issue

    I'm inviting (B2) my in-laws (Wife's Parents) and as per, I have to provide my Wife's Birth Certificate. The fact is that her birth date 27-NOV-80 but recorded as 27-JULY-80. As you can understand, in India, they adjust month for early school admission but now I'm facing problem.

    Of course, I don't have her Birth Certificate (Not applied) but If I request I can get for NOV as per Hospital records. Of course, I can't change all her records (Voter ID, Ration card, Passport, school, college certificates etc) which says JULY. But I don't want to lie anything but wish to go for best option. I did see alternative but secondary evidence should accompanying with "Non Availability of Birth Certificate" but Govt can't give this in my case.

    I've valid H1B and my wife has valid H4.

    Applying in Chennai Consulate.

    Any solution to this issue.

    You can't really get non-availability of certificate but the birth certificate is indeed available.

    I don't really see a way around this problem.

    You could possibly make one affidavit prepared where her parents can try to say that her date of birth is X but they didn't remember exactly at that time and therefore put Y.

    However, I am not sure whether it is going to work out or not.
