Hi, sorry it is 214(b )...not 221(g)
My name is Kishore and I am in USA from last 5 yrs, on H1b, working as a software engineer. My spouse is dependent.
My mother-in- law attended Visiting Visa interview (Telugu) on Oct 17 th 2011 at Hyd Cosulate. Visa is refused under 214 (b)- [white form ] of the INA. (No case number mentioned)
REASON: as per 214 (b) form:
reason for refusal:
You did not convince the consular officer that you satify all of the requirements of the law. All visa applicants must convince the consular officer that :
- they intend to leave the usa following temparary stay
-their financial situation is such that they can afford the trip without having to seek unauthorized employement in the US and
- the travel is for legitimate purposes permitted by the applicant 's visa category
Below are questions asked by Visa Officer..
Where are you going?
Ans: Baltimore
What is the purpose of the trip?
Ans: My daughter and son-in-law were there and to see places in USA.
Are you travelling alone or with your husband?
Travelling alone.
What is your husband do?
Told company name XYZ (my father-in-law is a central govt employee)
Why your husband is not coming with you?
My mother-in-law told again the company name …she is confused here
After that VO asked to give the documents she is carrying ….
She gave all the documents(employement letter, All sponser documents, her property document..etc)
Then VO looked at all the documents twice and gave 214(b) white colour paper.
Please give answers to my questions below. And also
Since no case number mentioned in 214(b) and VO gave passport back, we have to reapply …right?
Do I need to take new interview appointment?
Do I need to take HDFC visa receipt again?
Do I need to fill DS-160 again?
Is there any timeline for reapply visiting visa interview again?
What if visa is refused second time also??
Appriciate your help…many thanks!!!
Thanks,
Kishore.
