  • Rejection of visitor visa due to extended stay without INS permission.

    Hi,

My parents have been rejected for a visitor visa today. This is their 2nd trip to USA.The first time was in 1999 and it is for a 6 months period. At that time the Chennai consulate had stamped in their passport for a period of 8 months.Hence they stayed for an extra month in USA without getting a permission from the INS which we were not aware of then. This has lead to the current rejection of the visa stating as an illegal stay.

I have looked in the US Department of States site for the revalidation information. But I do not have answers to lot of questions for eg:Is there a revalidation form,an extra fee for reapplying ,any letter stating it is a genuine mistake, how should I file for this petition etc.

Is there a way to resolve this issue? In case yes, where can I find the details.Kindly, please post the details asap.Even a small bit of information would be of great help.I very much appreciate all your help for me.

    Thanks,
    Deepa.

Visa stamp is only for entering into United States. Actual period you can stay in US is determined by the date in I-94, at port of entry.

Unfortunately, there is no way to rectify the error now.

Being not aware of the law does not mean you can do it or rectify it.
