  • vistor visa rejected for unmarried sister

    hi,

i am a doctor doing my residency in US. My parents and my sister went for b1/b2 visa in delhi embassy yesterday. My sister is a post graduate student in 4th semester and was previously working. We were planning for my parents and sister to visit me for 2 months and do some sight seeing and shopping here. The VO gave the b1/b2 visa to my parents but denied it to my sister. even though my father said that she is going with us and will return with us. but the officer was not convinced and gave 214(b). I know it is difficult for unmarried sibling to get a b1/b2 visa.but her intent is to visit with my parents and then go back. please provide suggestion as to should we apply again for her in the next 10-20 days as this time she will go alone to appear in the interview. is it a good idea? what are her chances of getting the visa in case we apply again?

    thanks

Not a good idea. It is showing desperation and she will be denied again. Also, the officers think that your parents will surely return as long as your single sister is left behind.

I suggest she apply after your parents' have made a trip.
She is young , so she can wait to visit US. I suggest she apply during her vacation time ,
for a short trip ( 2 weeks) and while she is still in college.

thanks for the reply peace999......your point is completely valid.....the problem is she might get married this year and we were planning that this would be a good time for my parents and her to visit together...........what if i can get a letter from my university program director promising of her return after 2 months.....do you know of other experiences where a single unmarried student sibling was able to get visa in the second instance.....if we apply again wouldn't it convince the VO that the person is truthful and is not hiding any facts and that is the reason she is applying again instead of waiting for a longer duration of time.........your insight will really help me in making a decision as whether we can take the risk of re-applying again or not.....

They decide more on your situation than documents, they probably won't even look at the university letter you will get. Like I said , it is more desperation when your stated purpose of visit is just a pleasure visit. The officer will ask 'What is so important that you have to go?"
Another suspicion they will have is that you have an arranged match lined up for her in US
the reason she must travel with her parents.

Sorry for sounding negative but that is how it is. She stood a better chance if she was visiting
all alone for 2 weeks in her vacation time without your parents.
