  • US Visitor VISA App rejected - Need Help

    I am trying to get US Visitor Visa for my mother. Her application is rejected at Chennai Consulate without proper reason. We need some help to understand the requirement for US Visitor Visa.

    She carried all required documents to the interview as mentioned in immihelp website.

    Following document are provided to VO during interview.

    1. Original passport and photo
    2. DS-160 Confirmation page with CEAC bar code.
    3. HDFC Blue receipt
    4. Interview appointment letter.
    5. Form I-134 Affidavit of support form
    6. Letter to Consulate
    7. Invitation letter to my mother.

    VO started asking questions in English though we have opted for Tamil interview

    After her request, VO questioned in Tamil.
    Question 1: How many children do you have?
    She answered - 3 Children

    Question 2: What is your husband doing?
    She answered - Agriculture

    Just 2 questions, VO gave 214b notice and rejected the application.

    She carried all the supporting documents, but VO didn't verify them.

    Supporting documents:

    Employment letter
    4 month Pay Stubs
    Bank Letter
    6 Month Bank statements
    Original birth certificate
    Marriage certificate
    Family group photo
    My Passport copy
    My L1 Visa petition copy
    W2 form and 2010 tax returns copy.

    Am I missing something? I don’t really understand the reason. I am sponsoring for the VISA and all expenses. I believe VO should check only sponsor's financial documents.

    My L1 Visa got expired, but I94 is valid till Mar 2013. My wife is on H1 and we both work for the same company. Added both of our salary and mentioned in I-134 under Annual Income.

    Any help is appreciated.

    First of all, documents are not even looked at in most cases.

    They decide on the basis of answers to their questions.

    The most important issue they indirectly determine thru the interview is if there
    are enough ties for the applicant in India to compel him/her to return after the visit.

    If they are sure of that, then they consider the funding part.

    A lot of times denials are unfair and hastily taken.

    All she can do is try again after some months.

    Does she have any children living with her in India?
    If her husband has good income , she should
    show self financing instead of your affidavit of support.
    Ask for a short stay like 2 months.

      Re-apply for VISA

      Thanks for the response.

      We are planning to reapply next week.

      My father is not having taxable income. So i am sponsoring for her expenses.

      I have mentioned the following in my re-apply letter to consulate.

      The purpose of her visit is purely tourism. She can stay in USA only for 3 months, after which she must return back to India for the following reasons,

      1. My mother is a homemaker and she need to take care of my father, my younger brother (25 years old), sister (23 years old) and grand-mother (74 years old) in India.
      2. My parents need to arrange wedding for my younger brother and sister after her return from USA
      3. We have our own house and farm lands in our hometown. She helps my father in agriculture.
      4. All my close relatives are in India.
      5. She has fixed deposit in Bank of India.
      6. She cannot reside in USA as she cannot speak English and will be entirely dependent on me.

      Is it sufficient to prove home country tie? She don't have any property on her name.. House and farm lands deeds are in my father name. Do we need to provide Affidavit for properties on her name?

      I don't know what to mention in DS-160 reason for 1st time rejection as the reason is not clear. I am planning to populate the below explanation in DS-160. Is it sufficient?

      "VISA APPLICATION HAS BEEN REJECTED ON
      9-JAN-2012. I WAS ASKED 2 QUESTIONS ABOUT MY
      FAMILY. FAILED TO PROVE THE HOME COUNTRY TIE
      AND FAMILY COMMITMENTS IN INDIA."

        Hello Maya,

        I would recommend you to write reasons for previous rejection to be:

        VISA APPLICATION HAS BEEN REJECTED ON
        9-JAN-2012. Mention what type of rejection either 214b/221g that is sufficient, please don't give room for the officer to pick a new reason that was not a part of her rejection list.

        I would highly recommend you to apply for ur mother's visa again.All the best.

          Scanned Copy VS Original for US Visitor VISA

          I need to resend the re-apply letter to consulate and letter to my mom. Can i sign and send the scanned copy? Is it mandatory to send original copy of letters through mail.
