  • visa denial in Czech Republic

My girlfriend applied for a visa so that she could visit my relatives in the USA. She was denied under section 214(b), which states that she does not have enough ties to hold her here in the Czech Republic and she would emigrate (including money earned, travelling alone and education). I emailed the consulate asking for advice on reapplication and, unfortunately, all I received were reasons for denial and a redirection to the website. We have been discussing our options and are basically at a standstill.

My questions for anyone knowledgeable about this matter are as follows:

    1. When should we reapply?
The reply that I received from the consulate said that "It is generally recommended that applicants wait 12 months before reapplying." I don't feel that this is true in every case though. Optimally, we would like for her to come visit the US this summer and reapply immediately while we have the time/money, but if it means visiting at Christmas or even wait another year, then I suppose that that's what it'll have to be.

    2. Should we bring other documents?
We brought everything that was asked: a letter from her work stating length of time employed (2-3 years), bank statements from the past 3 months and a letter from sponsor (my father who stated that everything would be paid for which was, incidentally, not reviewed), etc. My thinking was that she should bring a more extensive letter from work (stating amount earned, reliance on her as an employee, etc.), a reservation for flight ticket (the examiner said that it would cost her 50.000 kc, but we were quoted half that amount at the airline office) and possibly a more extensive letter from sponsor, stating who he is (retired military officer, pillar of community, etc.)

    3. Should I go with her to the interview as travel companion?
I am, unfortunately, not working legally in this country as of yet. My visa process has been processing for quite some time now. For this reason I am scared that they would reject her visa on the basis that I am here on only a tourist visa. Should I wait until my temporary residence/work visa comes through or is that not of their concern?

I'm sorry for such a long post, but the denial was something that hadn't even occured to us and now it's making life more complicated than I ever imagined. I have no one to turn to for advice. I tried to do ask for advice from the consulate, but, that was already mentioned. If anyone has had a similar situation or could supply some professional/personal advice, feel free to contact me via email ([email protected]) of just reply to the thread. I thank you in advance.
