  • Extending B2 for old parent

I'm a GC holder working in US. My mother is visiting me on B2. She will stay her 6 months. I would like your help and suggestion in regards to my mother's situation.

She is 73 years old and handicapped. She has a house and pension back in India; however no one to look after her. It has become increasing difficult for her to manage by herself. As I work in US, it is not possible for me to look after her in India.

Is there any way I can plead on her behalf to USCIS for her continuous stay in US with me?

I understand that her B2 can be extended for an additional 6 months. So she can stay here for a year. However to my knowledge, she will need to return and won't be able to come back for another year. Is that true?

    Are there any other alternatives?

Once you become U.S. citizen, you sponsor her green card. (However, that has its own problems. Read https://www.insubuy.com/new-immigrant-insurance/-plans/)

You moving back to India would be an option so that you can take care of her.

Tourist visa is for short term. Extended visits are not allowed. She may be able to extend B2 visa once, but not all the time.

What you have mentioned about stay and extension is correct.
On a B2 she cannot stay continuously and it will be useless to plead to USCIS , as there is no immigration law that will allow that on a visitor status.

The options are you becoming a US citizen and then sponsoring her for a GC.
How long before you become a USC?
OR if you are rich you can get her here on investor immigration category EB5. ( $ 500k)

There could be another way if you are married and your wife's a US citizen.

        gc status

Thanks for the replies to my post.

peace999 - I wish my mother was that rich - I would have loved to inherit!!!
I received my GC two months ago. Seems a long way to citizenship.
        Thanks for the suggestions.

immihelp - If I choose to leave US, work in India for some time and want to return to US; what are the conditions to maintain my GC status?
