My husband has done a fraud and misleading the US court and taken one sided Annulment in US court while i was visting my parents in India. He is showing that the marriage never existed while we lived in the same home for 2.5 yrs and the marriage was legal and entered in good faith. I want to travel urgently what Visa should i apply as he taking advantage of my absence.

He applied for my AOS Green Card and convinced me to travel to India to meet my parents. He promised me that he will come with the Advance Payrole and my Green Card once it was issued. Once i left the country my Green Card got denied as i left the country while my Green Card was pending. I being innocent immigrant did not know the rules and he played a trick with me. He kept telling me that he is applying for a fresh application for me but he never did so. He is a US citizen by birth. Please help me as iam innocent and want to travel back to US and get my rights. Options;
1.You cannot re-enter based on your marriage unless your husband petitions for you again as a spouse.
2. Since this won't happen, you could try for a non-immigrant visa. But even there, you won't get a visitor or a student visa because you are not likely to come back.
H-1, L-1 visas are a possibility but for that you need an employer in US to file for you and
you must have the required education.
I strongly suggest you talk to a good immigration attorney over email.
it is a serious issue and you should not depend on a forum for a solution.Comment

Anyways just wanted to know if i get a sponsership from a friend in US to specify my stay can i travel on Visitor Visa saying that i have received a letter from a court about Anulling my marriage which he has taken on false grounds and i need to present in person before the judge to prove that iam innocent and he is taking advantage of me being in India. I need to appeal in the court within a specific time frame. He is a fraud and i have to proofs in writing whichi need to show in the court. Will they give me a Visa on humanitarian grounds.Comment
