  • Visitor visa after L1

    Hi Members,

    I would like to apply for visit visa to spend some quality time with my brother's family in US.
    I traveled to US last year on L1 visa and overstayed for nearly 2 months after expiry as my employer filed the L1 extension. As the extension takes long time I cam back to India and joined a new company. I am planning to apply for visitor visa along with my wife and 2yrs baby to spend time with my brother's family in US. Before asking my questions I would like to mention the main points about my case

    - My wife and baby have L2 stamping which was expired and they never traveled to US before.
    - I have expired L1 stamping and stayed in US for 6 months.
    - I also have the L1 extension petition copy. I kept it to show as valid reason for my overstay in the US.
    - No property on my name but my father's. I think parent's property wont work to show my tie up in india.
    - Have some Lic/MU bonds.
    - Have built bank transactions for the last six months.
    - Have parents, bro , sis and all other family members here.

    My Questions:
    - We are planning to go in july/august. can we appear for an interview in April?
    - Is it necessary to carry a certificate from employer reg Approved Leave?
    - Our neice's first birday is in May , shall we mention this as a reason for visa and visit US later in july because of our planned vocation?
    - Any other suggestions for preparing well for the visa.

    Yes, you can go for the interview in April.
    You need an employment cum leave letter from the employer mentioning that the job is ongoing
    and salary received. ( very important).
    No need to mention about neice. Just tell them you will be leaving in July.
    Must carry L1 extension papers( by the way, do you know if you were denied or approved extension)
    Most of the time they do not look at documents but only decide on the basis of your answers.
    Property , bank balance , .bonds are not so important but your income figure you tell them and its proof (salary slip/IT return) is a very vital point in the decision.

      I do have the payslips and the last 4yrs IT returns. Sorry I missed to mention that.

      Reg L1 extension. Its approved but I left the company.
