  • B2 tourist visa help

    i am indian citizen, i came in Uk after getting married, living and working in UK from last 3 yrs... applied for USA non-immigrant visa (before marriage) during 2007 in delhi, India, then after getting married i applied again in 2009 in london embassy and now again i want to apply as my whole parental family (citizen) stays in USA and wanted to meet them...

    Every time i got refusal without giving me any proper reason... first time the consular told me that i don't qualify for Non-immigrant visa, second time said sorry for not giving the visa....

    My question is should i try again this year with my husband as a family or alone... if i apply alone will there be any chance of getting the visa or not?

    2. Please post the 2009 interview whatever you can remember.
    3. Did you apply alone in 2009?
    4. Has your family in US ever filed an immigrant petition for you?

      No, my PR is due end of next year.

      The only thing right now i remember is that the consular asked me about my job (Permanent or Contract) (Answer was Contract) and The house where i was living was on rent or my own (Answer was Rented)

      Yes i applied alone without my husband.

      4. Has your family in US ever filed an immigrant petition for you?
      When my family got USA GC, at that time i was in the traveller list as family but when the approval came at that time i crossed age of 21 and as per USA rules... 21 yr child is not treated as dependent... so didn't get GC at that time.... but yes now my parents applied GC for me and my husband in jan 2009

        What about your job and accommodation now?
        (In 09, he was looking at your ties to UK. Since your job was not permanent and your accommodation rented, it meant less ties to UK for you to return. )

        Now, you have another issue to deal with. That is the filing of an immigrant petition for you by your parents.A visitor visa requires that you should not have an immigrant intent, so there lies the conflict.

        That said, sometimes the officer won't notice the petition column on the application
        and even if he does and asks you about it, you can say your current visit is purely temporary.
        You could apply alone citing husband is too busy and "I really want to meet my family."

          thanks for your reply...

          Presently i am working as permanent employee and live in house which is owned by my husband.... both things has changed but i think you are right that as my parents filed immigrant application for me and my husband that will be -ve point.

            Your immigrant category F3 ( married children >21yrs of US citizens) is backlogged about 10 years currently for India born applicants.

            I think you can stress on this point while applying for a visitor visa. If you really want to go,
            no harm in trying again ( except some money and time spent).
