  • I 94 query

I want to know that if I travel to US on a B1/B2 visa and then travel to Canada from US, then is my I 94 form valid or will I be given a new I 94. What is the minimum period of stay in canada to get a new I94. form on return to USA?

If your stay in canada is going to be 30 days or less , and your I-94 is going to be valid after your trip to canada, then take it with you to canada and you will be allowed back into US for the remaining period on your I-94. No new I-94 will be issued.

If your stay in canada is going to be more than 30 days then you will be allowed back into US only if your US visa is valid. And you will be treated as a new entry with questioning about purpose and stay. A new I-94 will be issued. In this case, surrender your old I-94 when leaving for canada, so your departure is recorded properly with US immigration.

Caution; Do not use this method to get a new I-94 , so you can stay longer in US.
In theory, you can be denied entry to US, if you spend more than 30 days and the officer suspects your
intent. Or he can just give you a new I-94 with a short stay like one month.
