  • Mother's visa got rejected 4 times - Mumbai consulate -214(b) - Help needed

    Hello,

    I need an urgent help.
I applied for my mother's visa recently for the 4th time and it got rejected again with same reason code 214(b). She is widow and home maker.
She had mentioned to interviewer that She gets around Rs 15000 - 20000.00 Rent per month and my younger sister is also working and unmarried.
They asked about the details of all her daughters and the intention to go to USA, which she replied. All of her 3 daughters are married, one is in India, 2 are staying in USA and youngest daughter is unmarried and working in India. Still she was denied with the visa.

I applied for her visa first time in Dec 2009, along with my younger sister, which was a mistake.Tthat time my younger sister was studying.
2nd and 3rd time I applied for her visa only, in Dec 2010 and Feb 2012.
4th time, My husband applied for my mom's visa yesterday and this time also no luck.
We can see that the problem is bze we 2 sisters are staying in USA in different States.
I am working on H1-B Visa. My sister is on H-4 along with her husband, who is on H1-B Visa.

4th time, when we applied for her visa, We thought if my husband applies, it may be positive, instead of I apply. But it did not turn out to be a good logic as well.

This case seems tough since she is widow and all of her 3 daughters are married, except one.
And also 2 daughters are staying in USA currently.
Definitely she has no intentions to stay here forever.

I do not see any further hope and would really appreciate your feedback.

    Thanks,
    Pooja

    Hi Pooja,

My mother applied 2 times in Mumbai, She is a single parent, two of her sons living in US (GC, H1B) and daughter unmarried living with her her first application was denied with no strong reasons of social and economic ties (marriage) per 214-b, she mentioned coming US for visit for 3-4 months.

Second attempt after 2 months and 15 days, this time we changed the situation from coming here for a graduation walk for 3 weeks. Visa officer didn't even looked at the documents..

They deny visa for 'single parents' and also age, if less than 60 looks potential immigrant who can work in US. I don't understand why they asked for situation changed, apply again. Looks like if our parents get different social status. I dont know what economic conditions they refer in the letter. though my mother has a job, property worth millions, family affairs to take care.

I am trying to seek legal help, will see what best "situation" can be produced for a single parent.

          Question on Potential Immigrants.

          Just Curios?

How can parents and in laws whether single or couple of Non immigrant (H/L) visa holders be potential immigrants unless the sponsor is in later stages of GC.

            I undersatnd your pain
My parents visa was rejected 3 times under 214b
I am on EAD through my husband which is employement based EB 3 category. I am wondering whether my immigration status is the reason for them not to get the visa.
I will appreciate any reply. I dont want to keep on trying if this is the reason

I will be applying visitors visa for my parents pretty soon and pray that they get it and for your parents too.

Keep trying within a reasonable time frame, as experts here suggest strong ties to home country is the key.
