  • B2 Visa for my mother, Help needed

    Hi,
    I am trying a B2 visa for my mother. My Mom went for an interview in Hindi on 13 Apr 2012 in New Delhi, but she did not get visa.
    Questions were asked

    VO: What your son do?
    Mom: answered correctly

    VO: What your husband does?
    Mom: Business, Canteen (I believe this was the problem, Please suggest)

    VO saw something on computer (probably DS-160) and said
    you have one more son (my brother, unmarried) in India and a daughter (My Sister unmarried) in India.
    Mom said: Yes

    and then VO denied the Visa

    1) Next time Should I apply for my Mom alone again?
    2) Should I apply for my mother and father together?
    3) Should I apply next month again? or whats is best time to re-apply?

    My father is retired (was doing a small business, and has a private canteen as part time now, not much income to show) and has no other income, has some property as Land (fields in village) and some savings of my Mom)

    I have one unmarried brother (architect) and one unmarried sister (student and teaching too) in India.

    Any help will be appreciated....

    You have not mentioned your visa status .
    Did you send an affidavit of support to your mother?
    Why didn't your father apply with your mother?
    What did she write on DS-160 , how long does she want to stay in US?

      Sorry about mentioning these things.

      Alok: I am on H1 Visa with my wife (H4 Visa)

      Did you send an affidavit of support to your mother?
      Alok: Yes I sent an affedavit of support (I-134) but VO did not see it.

      Why didn't your father apply with your mother?
      Alok: My father did not have passport at time of mom's interview, but he received just 2 days before.

      What did she write on DS-160 , how long does she want to stay in US?
      Alok: I filled DS-160 on behalf of my mother, and the purpose mentioned was pure tourism and stay was 3 months.

      Can we mention purpose of the trip to help my wife for pregnancy/delivery? actually we are expecting a baby soon.

      Please suggest me if you think that I did something wrong.

        Actually you did nothing wrong. Their criteria are vague and not uniform .

        Mainly They look at financial and family ties at home. Even if she had weak financial ties
        ( dad's low income) , she had compelling family ties with single children at home.
        They should have granted her the visa.

        Maybe with your mother traveling alone, they may have suspected pregnancy /delivery.
        I do not know why but they are biased against mothers going for pregnancy assistance.

        You cannot change the financial ties at home but you can try again with both
        of them applying. You have to compromise with the pregnancy thing.
        Let some months pass before they apply again. When they apply . let them stress that
        they have single children at home so they will return.

          Thanks a lot peace999 I really appreciate your quick response.

          1) Is one and half month sufficient for re-application?
          2) should I show that my father is retired ?
          3) Will my mom's visa rejection case be in consideration for next interview?
          4) Can I still sponser them ?


          So as you said " let them stress that they have single children at home so they will return." do you really mean single children?

          Actually they have one son and a daughter in India,and I am elder son in USA.

            Since you did not mention your dad's status as retired, you should avoid this this time as well.
            Just show he is in business . Do not rush into a reappllication . Can he wait some months so he can show a better income, expanded business?
            That income thing is the deciding factor, even if you are sponsoring ( you should).
            They will have your mother's last interview's noted points on the screen , so they will want to see a change in your parents' financial situation.

            Single-= not married.

              Thanks a lot peace999, your answers are really encouraging for me.

              Infact my father can not show any expanded business, he just look after a canteen which is run by servants and income is not much, they lives with my brother. Also We can not show sudden money transfer in their accounts.

              Is there any other way we can work on it? Do the transactions in the parent's bank account matters?

              Well If I am sponsoring then how much it depends on fathers's income?
              I can show all proofs of my income here but VO must ask my parents to show those papers. In fact I sent all those documents with mother at time of interview but unfortunately they were useless this time.

              Do you think this time it was financial issue only?

              Well from your point about financial situation of parents my father will go this time with mother , so land papers, jewelry and bank balance (which is not much) and two unmarried children in India should work with finger crossed


              Please answer as my doubts are getting clear by your answers.

                Yes, Income is important as a tie. even if your sponsoring, and your dad has good business and income, they think he will come back.
                bank balance, jewellery, etc. don't carry much weight.

                If he can't expand business, then just keep applying again with your sponsorship
                and let them stress that they have unmarried children so they will come back.

                  Will cancelation of my mother's visa affect my in-laws to get Visa?

                  May be If my in-laws get visa it would be great help for me. but I don't know how much it depends.

                  Please suggest.

                    Yes, you can.

                    But again it depends on their own situation in India.
                    If they have strong income/ family ties in India or not.
                    If they have better ties than your parents then let them apply first.

                    But wait a few months or the officer will suspect pregnancy again.

                      Can anybody help me understanding that


                      Do the VO knows that there are numbers of Visa has been applied on belahf of a candidate who is in USA?
                      For example my Mom went for Visa interview and did not get Visa, next time when my In-laws will go for interview, so the VO will have my mom's visa cancelation record infront of them?


                      Do they know if I (in USA) am the guy who is again sending somebody else for visa interview?

                      or there is no dependency as such?

                      I understand they will have record of my mother when she will go next time for interview but is it TRUE that the same record will be linked for anybody else other than the my mother?
