I-797 enough for sponsoring Visitor Visa ?

  • I-797 enough for sponsoring Visitor Visa ?

    Hi,

    I want to sponsor my parents' B1/B2 visa to US. I am on an H1-B visa. The visa stamp on my passport expired in October 2004. I have the new I-797 approval notice which is valid till 2007.

    My question is : Is a copy of my current I-797 (valid till 2007) enough for the paperwork required for my parents visitor visa or does the US consulate in india need a copy of an unexpired visa stamp from me. Because this would mean that I would have to leave US to get this Visa stamp in order to send the correct paperwork for my parents.

    Any help on this would truly be appreciated. It will save me a forced vacation to canada

    US Consulate does not care for your visa stamp....what they are interested is the legal status of the sponsor. You can send a current copy of your I-797 as part of the sponsor documents to prove that you are legally present in the USA. Good luck.
