  • Renewal of Visitor visa

    Good Morning Sir.
This is a query about visitor visa renewal and request for your help and guidance.
1.Myself and my husband are senior citizens(61 yrs and 61 yrs)Both are retired from service. We have one daughter in US who is married and is a USC.We have no other children.
2.Our visa was sponsored by our daughter in 2002 and we were exempted from personal interview as my husband was 57 yrs old(as per rules at that time, more than 55 yrs ,personal visit exempted) and our applications were considered together as one case.We received 10 year visas by courier and we visited in May2002 for 3 months.
3.Now our visas have expired on Feb 2012 and needs renewal , as we have to attend a wedding of nephew at Houston,in September.
4.We understand our application for new visas have no chance of approval under our daughter's sponsor ,as she is a USC
5.As such,we plan to avail of the Interview waiver program for renewal of visa, which needs no daughter sponsor or self sponsor,as per US rules cited here on your site only.
    6. From the VFS checklist to assess eligibility for the same,we have found we are eligible for the same as all answers are YES and want to proceed.
7.Now,we have to make an online application DS 160 and take confirmation print.
    My questions are:
    1. in the DS 160 form,we are mentioning under relatives in US details, about our daughter who is a USC now. Does this fact affect our visa renewal under IWP ,though we need not give daughter's sponsorship ? Will our visas be approved?
2..in case we fail to get visa renewed under IWP,should we apply for new visa all over, under Sellf
sponsorship as we have RS 50 lakhs FD,Own house worth 50lakhs,shares of 12 lakhs, and Rs 50k
    monthly income?
We prefer to get renewal of visas under IWP,without support docs.(daughter or self)!as it appears simple and there are no issues.[/B]
Advise course of action in our case.
Thanks for your time.Excuse me for a long post.

What you gathered about Interview Waiver is correct. Having had the same type of Visa before, Visa getting expired within 12 months from the date of application, and also applying from the same jurisdiction allows you to avoid the interview.

    (Q) 1 --> Irrespective of what the effect is on your application you will have to mention the fact that you have a daughter living in US and her status. This is not a choice but the good news is, if there is any effect it would be positive.

It is better to project this as a self sponsored visit.

    (B) It doesn't hurt to get an invitation letter from your daughter.

Based on your information I would say you have a very good chance of getting this visa. However there is a chance they may still call you over for fingerprinting.

      Thanks for reply.
I had sought following clarifications for IWP specific :
1.In our case,as we have only daughter who is USC and no other children.
2.DS160 form: under relatives in US details,we will indicate our daughter status as USC.
3In this forum only,I gathered that parents of USC child have no chances of getting tourist visa,if they have only one child and they are retired and not employed.
3.Under the circumstances, even under this IWP route, will our case be considered favourabl for renewal of visa?
We prefer to go the IWP way as it needs no sponsorship.
      Pl clarify our points.
      Thanks

The facts like (a) How many children do you have? (b) How many of them are in US or other countries (c) How many of them are in India (d) Their ages (e) Your job (f) Your income sources (g) Your fixed assets are are indices for the VO to assess the chances of you coming back to India or staying in US.

In your case with regard to your child you will be stating the facts. My advise would be to NOT read too much into the general statements / postings made on the forum.

If this were to be your first time going for the visa then I would be sceptical too, but if I have to guess you stand a very good chance of getting a visa since you have already had one before and you have come back to India as expected. Take special care about projecting a strong financial grounding in India and income to match.
