  • Tourist Visa for Mother and Brother

    Hi,

    I am on H1 visa for last 2 years and have all the W2 forms with me. I am planning to get my Mother and my Brother on a tourist visa.
    My dad is still working as a central government employee. My mom is a homemaker and my brother is 26 and is into the home run business for the past 8 odd years (although the business is not under his name and its under my uncle's name).
    I want to get my mom as my dad will not get any long leaves and along with mom wanted to get my brother as well.
    I have just paid the fees for both my mom and brother, yet to fill the documents.
    With the number of rejections happening on the lines of "suspect potential immigrant" increase day by day, i am bit worried of it.
    Please suggest if i should schedule for the interview of my mom and my brother on the same day or on a different day. And what happens if my brother tells to the interviewer that he is travelling along with my mom since she wouldn't be able to manage alone (i agree with the wheelchair assistance option, but just in case).
    Also, they have a valid reason to go back since - my dad and my sister (who just graduated) still lives in india.

    If you look at the US embassy New Delhi, non-immigrant visa webpage, there is a note on the right hand side saying,

    "families should apply together even if travelling separately'


    Your dad not traveling is a favourable thing.
    Yes, your brother can say he is traveling with his mother mainly because she cannot travel alone.
    I donot think there should be a problem with your mother's visa, but your brother being single, and young may face hurdles. His vocation and income is a very vital point in the decision.
    His business in uncle's name is not a good thing.
    He must be able to show he is well settled in his vocation with a strong income.
    Only then he stands a chance.

      Thanks for the advice.

      My concern of scheduling the interview on the same day was this - due to my brother's application (as he is single and a potential immigrant for the VO) would my mother's visa be under risk ?

      And for my brother to show he is having a strong income back at home - is it ok to show his bank balance in lakhs ? and all the property documents and the tax documents of the business we run (though its under uncle's name) ??

      And he is engaged and is intending to get married in Dec this year, does this point have any importance ?

        Well, it can affect this way;
        If he says she cannot travel alone and he is denied on income grounds, then both can be denied.
        If she can travel alone, and the officer is not convinced about your brother , they can give it to her and deny your brother. It happens a lot of times, some members of a family are granted , others are denied.
        So you have to strategise.

        About your brother; they ask about income, that is the most important thing.
        1O L /yr is the least min. he must show . If he can show business documents
        with his name in it ( as a partner with uncle) , I T returns, anything to show he is well settled in the business.

        Savings, property may not be asked and he may not have a chance to show it.

        "Engaged" , he will have to volunteer this info and it may or may not carry any weight. If he was married and going alone to accompnay his mother, it would have been a plus.
