  • B2 and Port of Entry

I am stuck in a problem and need advice.Me and my brother live in US.
My dad was travelling to USA last year in Feb.Due to the carelessness of the travel agents they issued a ticket with return date(+9 months). My dad didnt realize it and at the port of entry the CBP was questioning him and trying to ask him what his intention is.they granted 1-94 for 3 months finally after a second interview. Also he was unable to understand their speaking accent to answer their questions. At the same time due to some family mis-understanding between my Dad and my brother, when they tried calling my brother he said that he is unaware of my Dad coming here .thats y he got the entry for 3 months.

How can I get him back in US to visit me (his daughter)? He is a well-educated respectable man in the society .He does not deserve a drill from the CBP.

Please advice me ASAP. I really want to work it out.

    Thanks a lot in Advance

It is not a question of whether your dad deserves a second round of questioning by CBP. By your own admission you said he was carrying a return ticket that suggested he was planning to stay here for 9 months. It is understandable that he could not understand the accent and respond properly.

Anyway the outcome was good and he was allowed in for 3 months. I assume he left before the end of that period.

Now for this new trip, if he has a valid US visa with multiple entries, it is a simple matter of booking a ticket and just fly in.he may be eligible to re-apply for a Visa without appearing for a personal interview.

It will be helpful if you can post exactly what triggered the secondary interview at his last entry.

Usually they do not look at return tickets initially.
They ask you about the purpose and duration . What was his answer to these 2 qs?

        Thanks for ur replies.
When they questioned hime whats ur purpose , he said Tourism and staying with son. They said."No u must be lying" (seeing the 9 months ticket)..But my Dad dint realize it..He left within the i-94 date.

Does he require any kind of immigration clearance letter/stamp ?

          No clearance required.
What happened has no future implications.
Because he was given a 3 month stay and he left in time.

He can travel just like he did last time.
But he must be careful about the ticket and what he answers .
Get a return ticket for the duration he wants to stay.
But should not say more than 4 months visiting daughter
          ( that sounds too much
even if they will give him 6 months)

must carry your address and phone.

Thanks a lot for ur advice.
Next time , he visits , I'll make sure he has everything in tact.
But what if the CBP has added a note in his file which could pop up when they scan the passport.?

            Thanks

If they had a problem with him they would have denied him entry instead of giving him 3 months.

They cleared him last time means he is just fine.
