  • B2 visa reapplication help after rejection

    Hi,

    I need help with the reapplication for US B2 visa. My husband applied for visa on 29th may and got rejected. He mentioned that i am visiting US for my business purpose and he wants to accompany me and take a holiday together after my work is complete.

    He had all the necessary documents like his bank accounts, property papers, my invite letter from my client, our hotel bookings, my visa, an invite letter from my brother, etc.

    The interviewer saw my invite letter from my client and my visa (b1/b2) and said that she is not supposed to work on this visa and after few questions on both of our profiles refused his visa.

    But i am going there for business meeting only.. But for 8 weeks... Is that a reason of belief that i am gonna work there? also, he filled in his application for b1/b2 instead of just b2? is that why he didn't get the visa? Whe did we go wrong?

    Is there any way that he can apply again in June and get his visa n join me in U.S. in july? we plan on his travel in July.

    Are there any chances of getting his visa approved within one month of rejection? Are there any chances n if yes, then how should he present his case again now? What answers should he give?

    Please suggest.

    You have not mentioned if your visa is still intact or was it cancelled?

      ^^ The lady at the counter did not issue me the visa. Could she have also cancelled Ankita's visa? Is that is what you are asking @peace999? The lady did not mention anything like that though, just told me currently she cannot approve my visa application.

        I made changes in the thread to avoid any confusion. My visa is still intact. We just want to reapply for my husband (gaurav) visa.

          OK. Ankita3 , It is good your visa is intact.
          Gaurav, if they had cancelled it they would have put a cancelled without prejudice stamp on it.

          You need to post the interview in Q and A form .
          The reason for denial is usually hidden there.

            A: 30 days
            Q: Reason for your visit?
            A: Accompanying my wife for holidays, she will be in US already for her project, I wish to join her later for vacations, we'll visit all the famous tourist places.
            (She was still looking at me, so i continued)
            Thereafter we'll join my brother in law in California, and visit LA, Vegas, and Grand Canyon.
            Q: What will you wife do there?
            A: She is going for a project, will have business meetings.
            Q: What kind of work your wife does?
            A: She serves a client called GE Energy, and works in the risk assessment team.
            Q: What kind of work do you do?
            A: I am in the Business Development and Sales Analytics team in the same company as my wife.
            Q: Can I see the copy of the visa of your wife
            after seeing it - But this is a B1/B2 visa, she is not supposed to work with this.
            A: She is not going to work, she just has a project for 8-9 weeks, she has been invited by her client, she will have business meetings, finish the project, then join me for holidays.
            (i showed her the invitation letter from my wife's client)
            i also told her i have an invitation and the green card copy of my brother in law, but she did not show interest in looking at it. I also told her I have a letter of approved leaves from my employer, she didn't look at that either.

            She kept typing on her computer throughout, then told me that as per the immigration laws she cannot currently approve my visa application.

            I think I was unable to convince her clearly about my holidays, and my ties in India.

            The biggest question is: Do they have a record of my entire conversation, and the details of me telling them about my wife's travel? Also, If I re-apply in 15 days time, how should I present my case? I applied for b1/b2 last time, this time I shall apply only for b2.

            Edit: I presented the photo-copy of ankita's visa, not the passport itself. would they tell me then and there that my wife's visa is in trouble now due to my stupid replies? :-(

              In my opinion,
              *Both of you working in the same company and
              *you specially taking leave to join her in her business visit for VACATION TIME strikes as
              'not in the natural scheme of things'.
              Makes the officer think you likely have work lined up there and no plans to come back.

              I seriously do not think a re-attempt in the same situation will get you a visa.
              Let your wife return from the visit and you can apply independently at a different time and a
              different situation.

                Thank u for help and quick response. However, i we both are very keen to reapply for his visa and see if we can tell them that i am already there and my business meetings are getting over by 1st week of july. And then we plan to visit new york and new jersey. So i want to join her for one week (second week of july) and come back. And we can show hotel bookings and blocked flight tickets for one week?

                Will they have prior record of the detailed conversation about my time of travel and duration and all that?

                Additionally, if the visa is refused again, then do the chances of getting visa in the third attempt even after few years are difficult?

                What do u think?

                  3rd and subsequent attempts after few years will be assessed in the light of situation then and if the purpose, presentation and ties are concrete , visa will be granted.

                  Usually they note down the salient features of the conversation but
                  business visits come with a scope for some change in itinerary.

                    ok. so does that mean we should not take any chances this time in next 3 weeks? even if we show our proof of stay and return tickets for 1/2 weeks?

                      Proof of stay and return tickets are trivial things , they won't even look at them.

                      If he wants to try again he can say he won't get another leave at the job for a long time to come,
                      so this is a good chance to visit his relatives in NY, NJ with his wife. Do not say sightseeing
                      and do not say 1 week( too short). If his previous leave does not allow more time, forget it.

                        his previous leaves are for 1 month time. he planned to go to Atlanta on July 10 till 28 and then both of us would go to California to meet my brother for rakhi till August 10 and visit Las Vegas and all and then come back together.

                        That was the true plan from our side plan. but we didn't get opportunity to explain to the interviewer or communicate in any way.

                        do you think if this is concrete enough to try again and if yes, how should he communicate this.

                        I was also worried how will i stay all alone fr so long and wanted him to accompany me since he has already got his leaves planned.

                        is there any other option through which he can try. since i'll be in U.S. already in another 2 days, and he can tell that for medical reasons probably he would like to visit me. she is not keeping well and there's no one to take care of me.

                        or if there is anything else that we can do?

                          No frivolous reasons like medical reasons. They do it all day so they know.

                          Like I said in my last mail, let him try saying he wants to visit both your relatives for the month's
                          leave he has got.
                          July 10 is still far away.

                            yes. it is far away we plan to reapply for Visa around 3/4th week of june. please let us know if we can do something more to have better chances for the approval. i think one month is a good enough time to reapply.. but please let us know ur suggestions. your replies have been very helpful.
