  • EAD-GC vs H1 Visa

    Hi Immihelp,

    I am currently working in the US on H1 visa, which expires in 3-4 months. My spouse has applied for GC and is now in the EAD status. So, I would get EAD status, but not be the primary.

    My Query:
    If I were to bring my parents to the US on Tourist Visa, which would be wise:
    -> on my existing h1 visa (expiring soon) (or)
    -> on converting to EAD (I am not primary holder) and calling my parents on this status?

    Responses greatly appreciated. Further information gladly provided.

      If you have your EAD, then GC should not be far away.

      Visitor visa decisions depend a lot on the whims of the interviewing officer.
      So, sponosrship during an expiring H-1 and a transitional state like an EAD is best avoided.

      I also suggest give it a few months on your GC, have a stable job ( if a new one) and then send them an invitation.

        I have a stable, full-time job in a reputed company, while on EAD. Would it still be risky to apply for a visitor's visa for my parents??? Just curious...

            There is no hard and fast rule about sponsoring anyone when you are on an EAD.
            Like I said, it all depends on the officer.
            Risky??---- At the worst they will get a denial. There is nothing more to it.

            Also note that more important that sponsorship are their ties to India.
            For example ,If they are retired with weak financial ties and no children in india,
            chances decrease.
