  • Mother's visa denied

    Hi,
My mother had her visa interview at Mumbai consulate on April 18th 2012 and she was denied her visa and was given the 214g slip.

We had requested a Hindi translator for her and she was asked a few questions which she answered correctly, but fumbled (she says she was trying to remember the name correctly to avoid mispronouncing it) when she was asked where I work and was denied the visa. My father is retired and mother is a house wife. They do have some savings for a few years (approx 4-5 years) with a money lender. Nothing in any bank. Also, they have a property in my fathers name. My two elder sisters stay in India and I am here with my husband and a 5 year old kid. Last time we showed that their trip was self-sponsored since we thought that might be easier.

This time I want to apply for both my parents since my father is very confident in answering the questions. Also I am thinking of sponsoring their trip this time, however, looking at the previous posts I'm scared at the number of rejections in Mumbai consulate. My husband is on L1 and I am on L2 visa. I contract for a software company and will be ending my assignment in August 2012 for my delivery.

Please advice on how I should go about this. I am sincerely hopeing that their visas get approved this time so my mother can be here for my delivery in August.

I would really appreciate any help/ advice on this.

FYI, apart from my husband's incomes, I can show about $10k savings in my bank.
-Would this be sufficient for both my parents?
-What would be a good option? Me sponsoring or my husband sponsoring?
-Should I apply for their visa together or separately? (My concern here again is that my mother tends to get nervous even at the thought of interview)
-My 5 year old goes to school. Should I present proof of this? So they rule out the possibility that they are coming to take care of her?
-Should we mention about my due date in August?
-Please give any other suggestions that you may have.

Thanking you in advance for all the help. I'm counting on help from immihelp this time and hopeing that my parents get their visas approved.

    Thanks again,
    Optimist me.

OK .. let me clear up a few things for you here first .

    1) 221g form is a not a denial .. its request for Admin processing
    2) its now become a common practice for consulates in India to give any consultant related employee / his family a 221g form .. look up the internet or this form u will find 70% of the ppl get 221g these days .
    3) 221g whenever given - u will be given a slip with the receipt number on it and also the receipt will have a request for specific documents that need to be submitted to the vfs - usually
    4) the usual timeframe for processing 221g is 2-8 weeks from the day u submit the paper work that is asked for.
    -----------------------------------
Now coming down to ur situation ..

Things you need to do ASAP -
    1) ask ur mom to get that sheet scanned and send to you ASAP- both sides so that you can identify if they need any paper work to be submitted .
    2) also ask her if the VO actually told her that her visa was denied .
    3) ask her if he asked her to submit her passport / or did he return her passport to her.
    4) if the VO has told her that her plea has been rejected you may be better of withdrawing her plea altogeather and redoing it - with u sponsoring her .... i doubt though that the vo told her that her visa was denied. [ if she recvd a 221g slip ]

    Clarifications :-
    4) 10 k is enough for the visa -- average cost of a dependent person per month in any state would not exceed 2000$ so that is a good amount to show.
    5) self sponsorship is always a risky business .. u should sponsor her ... if she has less than 3-4 lakhs [ 5000-6000 USD ] in her account.

    Suggestions :-
    6) AUG is pretty close .. dont wait to reapply for visas for your dad and mom [ keep in mind 3 upto 3 months can go in they get another 221g ]
    7) sponsor them but ask them to go in together and try showing 12-15 k USD . Also provied them complete details of what you do and where you live and where ur son goes to school and where they would stay and wat cars you have . Ask them to carry pics of u and ur family [ in which they are also there ]. Send them ur lca application and employer contract ......literally anything and everything that the VO can ask them for.
8)from whats been going on lately in india chances are they may get 221g again so if they do they are prepared.

----------------- ATTACK THE 221G .. DO NOT SLACK ON PAPERWORK SUBMISSIONS IF ASKED FOR. -- REMEMBER THE MORE YOU DELAY THE HARDER IT WILL BE TO GET THROUGH. -----------

Firstly, thank you for the prompt response.

Second, my apologies for the typo. My mother got the 214(b) rejection letter. The VO told her at the end of the interview that he was sorry that she could not go this time.

      Answering the points below:
      1) She got the 214(b) letter/ slip. I will aks my mother to send it to me asap.
      2) Yes, the VO told her that her visa could not be approved this time.
      3) He returned the passport back to her.
      4) Not sure how to withdraw the plea. Is there a specific procedure for that?
      5) Since she received the 214(b) slip, I am thinking of applying for both my parents under a fresh application where I will be sponsoring their trip.

Thanks for the suggestions. I am waiting for my dad to get his passport before end of next week and as soon as he gets it, I will apply for my parents visa together.

Will also ensure that I send them every possible document that I think may be asked for.

One last question I have is:
      - If my parents have all relevant documents which the VO might ask for in 221g, will he approve the visa (considering that only documents is the reason for delay)?
      - I am asking this question so that I may prepare my parents accordingly. If at all they are given 221g asking for specific documents, which they may have with them, can they provide those documents to the VO right away?

Once again, thank you for all the help with this. I truly appreciate the time and effort.

Please let me know how I can withdraw the plea. My fathers passport came in yesterday and I would like to the earliest possible date for my parents interview.

        Thanks,
        Preeti
