  • Need urgent assistance

    Hello,
My situation is unusual. My husband lives in usa,i have been married for 2yrs.I live here in India.I know my husband for 7yrs.we both married under the consent of both the families. He processed my visa as well to join him after the marriage.he left to Usa soon after the marriage. My visa processing took time so i had to stay back. After i got my visa stamped,my in-laws destroyed my visa page,so i cant go and be with my husband,[i have that damaged passport].Then my husband was in touch with me,he consoled me saying everything will be alright and he will process my visa again once i get my new passport. After that he lost complete touch with me.All i know is where he lives in usa.[one may ask why r u keeping quite for which i dont have answer]...I applied for the tourist visa last year. They asked me why i want to go to usa,i told them my story that i have been married and my husband lives in usa and we are going through a domestic issue,i need to see him to find an answer for my marriage.consulate asked me to wait and he will call me again.after 15min he called me and asked me to go to a different chamber, where indian lady[atleast looked like indian]took my interview again. She checked my marriage certificate,my wedding pics everything and she asked me to wait again. Then the same officier who initially interviewd me called me and gave me white slip saying sorry...
Now once again i want to apply for the tourist visa,so i can go find my husband and come for conclusion. One may ask i can seek legal help,to be honest-i dont want to cause him any kind of problem because i loved him too much and though the time has gone too far and again for my parents sake, they dont want see me divorced, just a indian middle class indian parent's mentality,i still have a soft corner for him.I have a feeling, things will be alright once i see him.Again,i have read many blogs, its difficult to solve these kind of NRI marriage disputes and it takes time as there are lakhs of cases pending still.I really dont want to waste any more time,2yrs for a girl is too much.I am prepared for divorce or reconsile with him,but i dont want to give up without giving my try.
Now how can i apply for my visa?how do i convince them for the need of my visa?
    I really need help.
I will be very greatfull for any kind of information provided.
-I am not working here still
-i have enough assets and bank balance to sponser my own trip

    Sorry about your situation.
It is your personal decision but how can you think of reconciling with someone who
    destroyed your life.

They won't give you a visitor visa, because they think you may not come back.

    You could try for other visa classes;

What is your education and do you have any work experience

U r right, its meaningless to think of reconciling with him.Bu i have to find an answer for this right?I dont need police station, court hassels,i am completely broken inside and what ever it is,i want it to end in a peace note.I just need a smooth divorce. But for evrything i need him.

i am a medicine drop out.I have my investments and a partner in a business related to medicine.
I have a boutique in one of the prestigeous mall, but its only 3months old..
Apart from this i work as a freelance stylist, for ADD shoots I have worked for very big products like toyota and many other...
Does this helps me in any way to get visa?

If you had a bachelor's degree, you could look for an H-1 work visa sponsor in US.

Or You could start a branch of your boutique there, but for that you need lots of cash.

Student visa, you require money .
Religious visa you need to be in religious occupation.
There are several classes but nothing seems to fit.

Maybe you could contact a divorce attorney in india
what can be done when the husband has disappeared for so many years.

As Peace suggested, you need to seek legal recourse in India. US is a vast country, even if you get any visa, where in US are you going to search for your husband? I know its a long road in India if one gets into legal issues but that would be the only hope for you to be able to trace your husband if neither his family nor he himself is willing to come forward. This is my opinion.

I appreacite for the responses and thanks alot...
Can i try business class visa, using what ever business i am doing right now?
I have taken the legal advice here, all says it takes minimum 4-5yrs for the divorce as its a nri case.
If there is no option left,i dont have choice other than waiting for the yrs.I have already wasted 2yrs of my life and i really dobt want to waste any more yrs in his name. And its not easy also to live here being his wife for so many yrs before the divorce.

If i contact forgein affairs department, that would help me in any ways?

There is no "business class" visa. US Visa Officers would always want to know when you intend to come back, , with your case history in US immigration records, they will most probably relate anything and everything to that and would assume that you would never come back whether you find your husband or not as a result the chances of rejection are very high. I would again reiterate that there is no point trying to enter US for a person who has forgotten about you and who in most likelihood avoiding you. You have to file appropriate charges on the Contact certain NGOs which help in legal ways. But be careful there are many which might try to cheat you also, so carefully tread your path.
