B1/B2 visa for dependents of Australia / Canada PR

    This forum extremely helpful and hope I will get clear direction on my case here

    I live in Australia as PR with my family, having Canada PR and also B1/B2 given for 10 years.
    Now I am moving to Canada to work, my wife and daughter needs Canada PR to accompany me, it might take 4 months. My wife prefer to stay in US with her brother (H1B, living there for lat 3 years) until she get her Canada PR.

    My questions are
    1. Do we need to get sponsorship letter from her brother? Or this might have negative impact as unemployed person (my wife) in Australia having strong ties in US and hence not a genuine case for visit visa?
    2. I am with reputed company in Australia, earning more than 190K/Annum; with this just she can say that we go for family holiday to USA rather than family visit as a reason for visa?

    She will have visa interview in Perth middle of this week, is till to prepare DS-160 online

    1.her brother should not send sponsorship papers ( funding papers), as you earn enough to finance your wife's trip. He can just send an invitation on his letterhead and a copy of his
    passport and visa. She will have to show you are funding the trip and thus send your income proof with her to the interview.
    2. The reason should be to visit her brother for a few weeks with her daughter.
    Do not mention 4 months ; it is long.
    3. Do not mention about canada PR and you are moving to canada as this will show you and wife are abandoning your residence in australia which means a denial of visitor visa.

      Thanks for the response
      Another thing I forgot to mention, we all (including me) planning to go together, I will leave her in LA with her Brother and I will take next flight to Canada.
      Since her brother is not a sponsor, can’t we simply put his address in DS-160 and avoid his letter? I afraid to show any strong ties in US because application may be assessed only with my wife details (meaning she is unemployed going to see her brother who lives in US for many years)

        Since she will be mentioning 'visiting my brother" as reason to visit US. so they will know you have a family there. Just getting a letter does not mean strong ties. And you will need it and the passport /visa copy to show he is there.

        At all costs do not mention about your canada PR. You have to give the impression that
        the whole purpose of visit is visiting brother in US and then return to australia.
        Australian ties ( you and your job ) are very important.

          I am going to prepare DS 160 today for my wife and daughter (4 years old). I don’t have travel dates in hand, can I leave it blank or I have to put tentative dates!
          I believe we can’t upload any documents online except the photos!

          I am thinking to mention tourism as reason for visa instead of visiting her brother so that I can avoid providing more information about her brother.

            Just put some tentative date.

            On DS 160 , there is question where you must declare your immediate relatives in US.
            That includes siblings .So you cannot escape mention of your wife's brother and his visa status.

            If you will show tourism, it is better to have a plan and itinerary , where all will you be going
            etc., for how long etc.
            I still think visiting brother is not a bad purpose, since she is actually doing it.
            . It is something that sounds quite natural.

              Two more questions before I complete my wife DS 160

              I have only first name on my passport, typical south Indian problem, so B1/B2 was issued with FNU on First Name and my First name on surname. Now with my wife DS 160 where I have to fill detail of sponsor for trip, do I need to say my First name FNU to match my US visa?

              My daughter is only 4 years old and she do not require interview I hope it is good idea to apply her visa after my wife visa is approved! Or it will have any impact on my wife application?

                1. It does not have to match your visa. The point is to tell them that that applicant's husband is spronsoring the trip. There is no need to write FNU. You can write your name as you write normally.

                2. I think both should apply together, with your daughter's name included in DS 160.
                You should call VFS, to know how to do it together without your daughter having to go.

                  In DS 160 we mentioned that indented stay is one month but I have invitation letters from my BIL inviting for 1 month and also 3 months ( 2 letters )..Which one to use? I am afraid that it may be single entry visa with one month validly!

                  My wife interview is schedule at Perth office tomorrow, fingers crossed!

                    But don’t know whether it is single entry or multiple and what is the duration, another 3 days waiting
