Wife's B1/B2 Rejected. 214(b) What Can i do?

    Hello,

    Someone do read and help if possible,

    I have a 10 year B1/B2 Visa valid until 2022, My wife had a B1/B2 from 2001 - 2006, then she got a F1 visa from 2006-2011 November, but in March 2011 she moved to India and we got married.

    I have a real sister in the US. she has a Real brother in the US. both are green card holders.

    Today she went for Interview, and all the officer did is go through her passport, asked her how long does she plan to go, she said 3 weeks, she asked what do you do in India? She said im a home maker and also am working part time with my husband who is right now training me. Then she asked whats your salary annually, my wife said 3 lacs, and husband is 21 lac, and the officer said sorry I am not able to give you a visa today. She just gave a 214(b) letter.

    Can anyone help what exactly am I to do? What exactly and how do I improve her ties here?

    Below are few points for refrence.

    1. I have had B1/B2 since 1996, gone to US to see my sister every year.
    2. My wife had a b1/b2 and then f1 which expired in november 2011. she did MBA there.
    3. We are into construction my last 3 year ITR show a net income of 18.60,000 INR
    4. in My wife's DS160 we answered who will pay for trip I wrote my name but officer asked her none of my documents etc.
    5. She took original marriage certificate , photos but none were even asked for.

    Can someone please advise what am I to do next? Really would appreciate it.

    P.S Also a purpose of the trip was to attend a family wedding in UK in August, and now if I apply for her UK visa will that cause a problem too? As in UK visa they do ask if uve been rejected before? Ive been to UK multiple times in life but she has not?

    Did the officer ask her what was her purpose of visit?

      Yes she asked and wifes answer was to see my brother and my sister in law.

        Visitor visa decisions are sometimes unreasonable.

        Maybe the reason(s) were GC brother in US, the low income she stated of herself
        3 lacs, and she going alone for just 3 weeks.

        If she reapplies with the same situation , they will deny again.

        If you are going on a business trip sometimes, she can show that she is accompanying you.
        Without any mention of visiting her brother.
        But you must wait a few months before reapplying like that.

          Thanks so much really,

          I was under the impression that since in her Ds160 form we wrote ill be sponsor they would least care about her Income. Also next time if we don't mention her brother would it not be on record that she has a brother with a GC ?

          Also she mentioned she will be traveling with me, it's so funny both of us have been to US multiple times on last 10 years and this happened, honestly quite baffled.

          I assumed since she has a lot of money there it might have caused a problem? about 64,000 USD and we have not yet transferred it to India, another issue i felt is since her passport still does not bear me as a husband officer thought shes planning to run away?

          This is what I intend to do, apply after March 2013, increase her income to 80,000 rupees a month, transfer all her money into India and then apply? I hope it works,

          Also lastly, any clue if this rejection means UK will also refuse the visa? The papers are the same and again I will be the sponsor?

            She will have to mention her brother in the DS-160 question; Do you have any immediate relatives?
            But she does not need to mention that she is visiting him.
            Secondly, if she said housewife , she should not have said she is being trained by you and she is earning 3 lacs.
            She should have just mentioned that you are earning 21 lacs and you are spending.

            I do not think money lying in US has anything to do with it. Did she disclose that to the officer?

            I think UK people will assess it on its own merit. I suggest she should not make the mistake of
            mentioning her part time work and earning 3 lacs. She should just say she is a housewife.

              My real sister is in the USA and when I filled my form I mentioned it, and no she did not disclose the money in US but i assume with her social secutiry it would show on screen?

              I will just apply next year as we don't plan to go anytime soon, will also get her income to 1 lac a month lets hope it works,

              Applying to UK next week and then Schenzen (France) I just hope it goes through smooth.

              One issue I face is she is not indian passport holder so I assumed with so much money there, and her real brother with a GC and with her passport still not endorsed by my name they assumed she is going to run away? Just a wild guess, honestly so confused,

                      Different nationalities and no name endorsement ; could be a reason!!!
                      I still think her mention of a low income and part time work was wrong.
                      Anything vague and not concretely stated , the officers tend to deny.
                      If she had just said housewife , it would have worked showing your good income.


                      I am not aware about Indian immigration laws, but when can she become a naturalized Indian
                      based on marriage with you? I mean can she get an Indian passport in the near future?

                      Also, your plan to apply next year is good.
                      If she gets a schenegan and UK, a recent history of travel to those countries will be a a positive.
