  • Multiple travels between US & Canada on Multiple Entry visitors visa

    Hi,

    My parents have both US & Canada multiple entry Visitors Visa. They are currently in Canada. How many times can they travel between Canada & US?

    Their total trip duration US + Canada is not more than 6 months.

    We are currently planning to cross the border from Canada to US three times; 2 times at Niagara for a span of 2 days each time and then by flight into JFK, New York for a 3 month stay.

    Is there an issue in this nature of travel?

    Please advice.

    Thank You in Advance.

    1. Was canada their first port of entry from India?
    2. How much stay are they granted in canada?

        Canadian border agency says;

        Your single or multiple entry canadian visa will allow you repeated entries to USA within the period authorized for your stay in Canada.

        USA Customs and border protection (CBP) says;

        Under most visa classifications if you take a short trip (30 days or less) to Canada or Mexico, you may retain your I-94 so that you are readmitted for the balance of the time remaining on your I-94.
        **** **** **** **** **** **** **** **** **** **** **** **** **** ****
        Going by the above directives , technically you can execute your plan of 3 entries, but in practice, it would be advisable to avoid that.
        Third country nationals going back and forth on visitor visas too frequently can be a focus of scrutiny.
        Especailly the US side of officers at niagara crossing can be tough and interrogating.
        To avoid unnecessary hassle, make the total crossings to 2.
        One at niagara and one to JFK.

        There is another thing; if their first US entry is for the purpose of visiting niagara, they is a possiblity that they will get a short stay
        on their I-94, which can be tricky if your next visit to JFK is beyond the date on the I-94.

        1. What is the time gap between their visits to niagara and JFK?
        2.Will they be departing for India from US?

          Thank you for your reply.

          1. What is the time gap between their visits to niagara and JFK?
          --First entry at Niagara for 2 days and 6 weeks later, enter in via JFK for 12 weeks

          2.Will they be departing for India from US?[/QUOTE]
          -- From US, they will enter & exit at JFK in 12 weeks. They will go back to Canada and then back to India

          Their overall trip leaving & returning to India is within 6 months.
