  • More than 180 Days Stay over Multiple Trips in a calendar year

    Questions:
    --------------
    1. My mother's last trip to visit us was from Dec'11- 30 May'12. We wanted to have her come over again for 3 months this year, say from Sept - Nov '12. Is that possible (it would then become an 8 month stay in a calendar year)? Would INS have an issue with it? We had read somewhere that it is probably the expectation of the US for tourists to stay no more than 180 days per calendar year.

    2. I am hoping I will get my citizenship by mid-next year. I would then like to apply for my mothers green card while she is visiting us in US. We have heard that INS prefers that people apply for GC from their home country (consellor processing); we do not want to do that as I have heard it takes about a year for the process to complete. And my mother is old and single and I cannot let her be away from us for a prolonged time.
    2. (a) What is the best way to manage that, in terms of timing and stay of her visit at that time? do we have to wait a few months of her stay before applying for her GC?
    2. (b) With another trip built in this year (as specified in query #1 above), do you think there will be any problem with applying for her green card next year?

    3. Approx how long would you think it takes for citizenship to come through(assuming no queries are raised)? I am expecting to apply for my citizenship on 28th January 2013, as the 5 years for my green card gets completed on 28th April 2013.

    Background:
    ----------------
    1. My mother has been a frequent visitor to US for the last 10 years on a 10 year multiple entry tourist visa. She typically stays 6 months each time.
    2. Only once in 2003, my mother had stayed for about 9 months or so, after we applied for her extension to stay and subsequently received approval for the request from US Immigrations Services.
    3. Upon expiration of her 10 year visa, we reapplied for her visa in July 2012 and easily received another 10 year multiple entry visa.
    4. My mother has just 2 children, and both of us are green card holders in US. We are both, along with our spouses, well educated and hold good jobs.
    5. I am expecting to apply for my citizenship on 28th January 2013, as the 5 years for my green card gets completed on 28th April 2013.
    6. Once I receive my citizenship I am planning on applying for my mother's green card almost immediately.
