  • Parents Visa to visit 6 month grandchild is valid reason?

    Hi,

    I had applied visa for my parents in Jan 2012 ( I sponsored that and applied at New Delhi, India) but which got rejected with no reason given. Here are some major points.

    1) My father is Accountant in U.P. Govt. department and will retire after 5 years.
    2) My mother had leg injury so went on wheel chair during interview. Now she is fine and can walk normally.
    3) My wife was pregnant and bay delivery was in mid Feb 2012 but I didn't mention that in invitation letter and also consulate didn't ask about this. I had mentioned purpose as ' To see me and tourism'.

    so, not sure why consulate rejected visa.

    Now I am planning to apply visitor visa again in August 2012, for both so I have following questions

    1) Can I show purpose of visit as to see 6 month GrandChild or will consulate think they are coming for babysitting ? or this is good reason ?
    (Note : My wife is with me and not working (on L2 Depedent Visa) even I didn't file EAD for her)

    2) Should I show US tourism as primary reason for visit ?

    (Note : My L1 visa is expiring in Nov 2012 but I94 is valid till Feb 2014)

    If you post the VO questions and corresponding answers by your parents a more insight can be provided as to what went wrong in the interview. Your US records would already be showing that you recently had a baby so there no point hiding it. At the same time explicitly volunteering that info is not required. 6 Months trip just to see grand kid will not seem a very convincing reason for visiting US. They should just mention to visit you and see US. A lot depends on ties to home country, are they self sponsoring? Who else is there in your family? What are they currently doing? Are your parents self sponsoring the trip? Basically VOs are looking for reasons which will convince them that the person seeking visitor visa will return back to the home country and the slightest doubt they get they will reject. This is my opinion not legal advice.

      Below is conversation with my Parents with VO

      Father (Interview was in Hindi)
      -------

      1) Why are you going to US ?- > We are going to visit USA and see my son in USA
      2) For how long son is in US ?-> approx 1 year
      3) Where will you go ? -> I will go to Bellevue ( VO told in 'Washignton' then my father told 'yes')


      Mother (Interview was in Hindi)
      -------

      1) How many children you have ? -> I have two sons.
      2) Where is second son ? -> he is in India
      3) Which company he works ? -> {unfortunatly my mother didn't remember his company name so my my father answer this question but VO told that please let her (mother) give answer so my father told that she is not so much educated and often forgot names, so VO told 'Ok, then you let me know the name', then my father gave her answer. } So, I think this is the reason they didn't give visa

      After that VO asked to my father

      4) What you do ? -> I am a Accountant in U.P Govt.

      [I had sponsored them and also sent a bank verification letter and had approx 15K money in my account]

      -- Who else is there in your family?
      [I have 1 brother/his wife/his 2 year daughter staying in India. Brother works in Software MNC in Noida. Also my Grandmother is also In India]

      -- What are they currently doing?
      [Father is accountant in Govt job for last 25 years with salary around 4.4 Lakhs per annum and will retire after 4 years and mother is housewife]

      Except this : My Mother has a house with her name, my father has a residential plot with his name and also got some farming land from his father but VO didn't ask for any document at that time.


      So, I am again planning to sponsor them and aksed parents to take a affidevit of all property, NOC letter from Govt dept ( they also took previously).
