  • B2 visa situation - help

    I applied for a B2 visa recently. I had overstayed on a previous visit(in may) on a visa waiver as I qualified for one, so I tried for a B2 visa since I couldn't travel on a visa waiver anymore. I overstayed by 8 days.
    I was rejected under section 214b. I had to tick the question on the DS156 form that states you have stayed unlawfully.


    Will it be a problem if next time I apply(next month) they see I have overstayed 8 days, will they even bother to look at my documents? Also do they pull up your old application when you apply again? I have new evidence such as job, and enrolled college to show, will it help?

    The situation will be similar to when you were rejected. You will
    have to check that box next to unlawful presence on DS 156 again
    and it will be the same story again.

    There is a better way;
    Be honest.
    Think of a convincing reason to tell the officer why you overstayed.
    And why your current visit is important.

      When I called to schedule another appointment, the person scheduling it was quizzing why I was applying for a visa so soon after and was quite rude basically telling me I'm going to get rejected again.


      Am I likely to be rejected next month as I was only rejected this month? Even if I show proof of ties and funds? What will they be looking for? Will they just look at the overstay of 8 days in May and deny me again?

        Most likely, yes.
        The ovestay issue is the most important to overcome in your case.

          Hi,
          I cancelled my August appointment, and rescheduled for september. I have been working since July, and am only requesting to go for a few weeks for vacation time.

          Can you give me any advice on what to take to help convince them that there is no immigrant intention?

              Firstly, since you overstayed your stay in May, you should have delayed
              your application for the B2. An overstay, a refusal and a reapp so soon do not look so good.

              Is your visit actually urgent? If not, cancel the appointment and
              apply again maybe at the end of the year. If it is really urgent,
              carry the evidence of urgency with you.
              In both the cases, focus on giving the consular some good reason
              for overstaying 8 days.

              Carry a letter from your employer giving you leave.Your property,
              business if any, your investments at home , your family,
              all prove ties to home country.

                Hi, I am a United Kindom citizen, and the visit is not urgent. It is supposed to be a vacation with my mother, who lives here too and has strong ties to this country.
                So basically even if I show I have a good job, economical ties, strong family ties here, limited time in the US - they will probably deny me and overlook the evidence, based on the fact that I have a previous overstay and a refusal?

                Is the evidence that I took the first time around to the first interview on their files anywhere?

                I am sorry for all the questions, I'm just trying to make sure of things. Thankyou for answering, it is appreciated.

                  Yes, consulars take overstays very seriously. They want everyone
                  to respect immigration laws. So, this is the most important issue
                  in your application.

                  I'd suggest you apply when you have a real situation to go,
                  like a business urgency or an interview that would really require
                  your being there. And at the interview, VOLUNTEER first to explain
                  why you overstayed and apologise that it will never happen again.
                  Then go on to explain the real need for you to go.

                  They keep all salient features of every interview on record.

                      ; 6 years later I know but did you ever get a favorable response from the embassy. My mother in law is being accused of overstaying even though she did not. She has beem refused the b2 visa twice. Please any advice will be appreciated
