Rejected when applied through company, now applying with family - tourist visa

I am situated in Pune, unmarried, working in an Indian company.
I had applied for Business visa in Mumbai in January through my company. The company had sent us with the sponsor letter and all other important documents. But my visa was rejected. I was only going for 10 days to NY then.
But now I'm want to go on a vacation with my family to US. My real brother is on H1 visa in Texas through Infosys. His visa is expiring in June, 2013. So he is inviting us there. I am still employed in the same company as I was in January. My parents are in Chandiagrh, so they will go to Delhi to apply. I am planning to go to Mumbai, as I reside in Pune.

My questions:

1. Should I apply together with my parents in Delhi? Or should I go to Mumbai to apply?
2. Should I self sponsor? Or should my brother sponsor? (I am in a good job with a very good pay)
3. I will take the vacation letter (kind of a NOC), and pay-slips and employment letter from my company. Do I require any other documents from the company? Do they see any documents? Last time, they did not see any documents.
4. Do they ask any questions like why was my previous visa rejected? What should I say in that case, if they ask? (I don't know why they rejected my previous application. They don't give any reasons)

B1 apps are always more seriously considered than B2 ( tourist). So when you have a recent B1 denial, B2 won't work .
Especially when you are a bachelor( no family ties).

Please post your interview for your B1 denial , so we can figure out why you were denied.

I was rejected under 214(b). I was given a letter of rejection.

I was asked the following questions during the interview:

1. What is you purpose of the visit?
My reply: I am going to the client's office to understand their requirements for the project, etc. etc.

2. Have you travelled anywhere out of the country before?
My Reply: No, I haven't

3. How much time were you employed in your previous employment (Cognizant)?
My Reply: 11 months

4. How much time have you been with the current job?
My Reply: 1 year, 1 month

5. What's your age?
My Reply: 24 years.


There might be 1 or 2 other questions which they might have asked me, but I don't remember.

The denial was pretty straightforward. The VO felt you are too young in terms of age and experience to be sent for Business Meetings/requirements gathering, the primary purpose of B1. Self sponsoring pretty much works only if one is having an official income of over 15-20 Lakhs per annum. Also, your brother already being in US might lead to VO assuming he will help you get a job there. To be honest you have a slim chance of getting B2. You would have to mention 214B as reason for previous Visa rejection. the next tiem you fill DS-160. You can surely try to apply and might get lucky. In fact, you staying in India is a strong reason for your parents to come back hence they have stronger chance of getting a B2 provided you don't attend the interview with them. In my opinion, they should attend the interview first and once approved, you can try for yourself and say that you want to accompany them for a trip to visit US and your brother. This is my opinion not legal advice.

I will start my fee deposit by then and then I will go to Mumbai for my interview and I will say that I want to accompany my parents and I have been given a month's leave from my company. Should I say that they have recently got their visas and now I want to accompany them.
Will they ask me why was my previous application rejected?

Hi, I went for the interview. But got rejected again.

Questions asked:
1. Why are you going to the US?
Ans - I want to visit my brother who is staying in Plano, Texas and to see some interesting places in the US.

2. Do you have clients in the US?
Ans - Yes I have clients. But this time I'm going for tourism purposes with my parents. My parents have already got their visas last week. I will be travelling with them.

3. What does your brother do in the US?
Ans - He works for Infosys on a project for Pepsi Co.

4. Is he on H1B?
Ans- Yes

5. What is your age?
Ans - 24 years

6. Where do you work?
Ans - I work for (name of company) in Pune as a product manager

7. What is your salary?
Ans - 8 lakh 5 thousand annually

That's it. They didn't ask any questions and rejected my visa again.
I told them again, that I am travelling with my parents for a month. I have got a vacation letter from my company also. My parents have already booked their tickets. But they didn't listen. They said come again when you're 'more eligible' for a tourist visa to the United States. What do they mean by more eligible?

Now I won't be able to apply again ever I think! Everyone told me to tell the truth. I told the truth and this is what happened.

Its sad whatever has happened. Unfortunately, young, unmarried, IT person with an OK income, with Sibling in US, parents already holding a visa creates a combination which many VO see as reason enough for rejection. You can try if some of these facts about you change. Better luck next time. This is my opinion not legal advice.
