  • B1 Visa for Widow Mother

I am working in USA for last 7.5 yrs on H1-B and my green card application is pending in EB-3 category. I applied for visitors visa for my Widow mother twice, and it got rejected both times. First time it was in July 2010, when she visited Delhi embassy for interview and they rejected without giving any reason. Second time was it was in Oct 2010 with my brother in Mumbai Embassy. My brothers interview went well but when they interviewed my mother, they rejected visa for both of them. Second time my brother proposed to sponsored the US trip for both.

My mother is house wife. She has no personal income. She has many properties in her name or jointly with us. She has some investments approx. Rs 10 L in India. We are two borthers with both married. My mother currently lives in Delhi with my brothers family (brother, his wife, and two kids). I am live here with my wife and a two year old kid.

I am planning to apply again in next few months from Delhi Embassy. I am thinking of asking my brother to sponsor her. In addition I am intending to show that she has been volunteering for an educational organization in Delhi for last one year teaching few hours every day. In addition we are proposing to show that she wants to travel for 30-40 days only to attend birthday of her grand daughter.

Could you guys provide additional suggestions and recommendations? What else can we do? Is there any way we can increase chances for her visa??

unfortunately and unluckily Widowed mother/father with no income/business of their own, and not much family ties in home country are mostly rejected for visitor visa as they are strong candidates for potential migrants. Rarely are bank balance/property papers/investment papers seen as VO are very well aware that all such documents can be easily procured in India. There is not much that you can do besides trying again. You can certainly show her teaching as current job if she is getting a decent income also, a confident mom who is sponsoring her own trip out of her pocket might help at the same time a request for 30-45 days. Besides this just hope a good VO and some luck. This is my opinion not legal opinion.
