  • Tourist VISA while with pending I-130 from spouse

    Dear All,

I would like to seek an advise. My husband is a US green card holder and he applied I-130 for a petition for me last January 2012. I am currently living and working in UAE. Thus, we are far from each other. In order to see my husband even once/twice in a year, is it okay if I apply for a tourist visa while with pending I-130 petition from my husband? How many years of waiting for the petition?

Please help and advise. I am looking forward to receive replies on these queries. Thank you.

    Sincerely yours,

    Thalia

Try. But if you have a pending I-130, your chances of getting a visitor visa are very, very low. It is indeed unfair - but the assumption is that, because you're waiting on an immigrant visa, you're MORE likely (not less likely) to illegally immigrate.

      Hi Everyone,

I wanna share with you all, that nothing to FEAR in applying tourist visa (b2) while there is a pending I-130 application from spouse as my Tourist Visa just got approved today, 3 Dec 2012. The consulate officer just asked the following:

      1) How long you've been here in UAE?
      2) Married or single?
      3) Where is your husband? What is he doing?
      4) Which state?
      5) Whats your job?
      6) Can you show me your NOC and bank statements?
      7) Congratulations, I am approving your Tourist Visa!

Im so happy! Thanks immihelp.com, the tips for interview works!

      Regards,

      Thalia
