  • Extension rejection paperwork lost - thoughts?

    I know the situation below sounds really weird, however it is real.

    In 2003 April, my in-laws came to visit us from India and when they arrived, they were authorized a 6 month stay. Their visit was supposed to end in Oct. In September we applied for an extension of stay. However the extension was rejected and we got the rejection notice early December. They therefore left at the earliest available opportunity which was Dec 31st, 2003. My father-in-law took the rejection notice with him and unfortunately, he destroyed the paperwork early this year, without realizing that it was an important piece of paper. Now we have no record that we actually did apply for the extension during their last stay here in the US. Unfortunately, we do not have any copies as well nor the WAC #. (See my disclaimer above!).

    Now we are trying to see if they can come visit us again this year. They have traveled to the US extensively before and had a 10-year multiple entry visa that expired last year. So they are appearing at the Chennai Consulate later this year to apply for a new 10-year visa.

    I have the following questions -

    (1) How can I get a duplicate copy of the rejection notice? I am trying to get a copy of the cancelled check to see if it has the WAC # and if so, can I still use I-824 for this purpose - even though I-824 is for approved petitions only? Is there any other way to get a duplicate copy?

    (2) The extension request in 2003 was the first and only extension request they have made thus far - they have been here probably about 15-20 times. They have property and stuff in India and have recently retired. How much of an impact will the rejection have when they apply for the 10-year visa later this year?

    Any thoughts will be greatly appreciated.

      Lost the extension approvals

      My parents-in-law have a 10 year multiple entry visitors visa since 1999. They visited in 1999 and 2001 and both times we extended their visas and both times their extensions were approved. They seem to have misplaced the approvals and we dont have a copy of the approvals.

      They visited again in August 2003 and left in Jan 2004 (5 months visit). They are planning to visit US on Sep 6th 2005. Will it be a problem if they dont have copies of the extension approval in 1999 and 2001?

      How easy is it to get a duplicate approval copy and what all documents would we need? Can we get the duplicate before Sep 6th?

        Hi all,

        This info can be useful to u guys. My in_laws visited us in the year 2001. They got 10 year multiple entry visa. In 2002 we invited my MIL alone for the delivery. That time we extended her I_94 in california service centre. Her extension was approved. Unfortunately we lost the extension approval paper as well as the receipt now, and we are planing to invite her again this year.

        I applied thru' G_639 form(FREEdom of Information act/privacy act form which states searching for lost records), we did not have the original receipt number but we gave maximum information we could including dates, original I-94 number etc. Faxed form G-639 to india to get it signed by her and as well as notarised. I applied in the month of July and this week (after a month) I received a letter from the USCIS stating ur record is there (they mentioned the original WAC number that was not given by us, guess they found the record themselves). The letter also says we will inform u if any fees need to paid, since fees are applicble to only if the search time exceeds more than 2 hrs and if ur records exceeds more than 100 pages. They have put our case in simple track (upto 20 days) since it is only 2 pages that we are asking for, for more complex cases it might take longer.

        Any way I am waiting for the approval copy, I think the above info will be useful to some of u guys. I will also update when I get a copy of the approval notice from USCIS.

          Thanks very much for your response. Quick question - you say that if the request is simple, then it gets put on the simple track (upto 20 days) - what does this mean? Is it 20 days from the date of request to get the copy or is it 20 days after they decide that they can find it or what else? Please provide insight.

            extension paperwork lost

            Hi sesha _srini,

            As far as i know there are 2 tracks simple and complex tracks.Records of small no of pages(what i have requested is a single page) that takes lesser time to find out are put in the frist i.e simple track.Records that takes more time to locate i.e more no of pages are put in the complex track.

            In my case our record has been located as they have found the WAC no of my MIL which we did not give.But I do not know how long it will take to get the copy in hand,as people say it takes more than 6 to 7 months for them to take print out and mail it(as there are more than 32,000 requests ahead of us,this info i got it from the other thread,not too sure).

            Anyway we will have to wait and see.

              Visitor Visa Extension Documents Lost

              Hi,
              I am also facing the same issue with the extension documents. I am trying to submit the G-639 document. Can you please let me know how much it took to get the original documents

                Hi all,
                My mom visited us in the year 2005. She got 10 year multiple entry visa. We extended her I_94 in Nebraska service centre. Her extension was approved. Unfortunately we didn't know that we would need the extension approval letter again and we didn't save it properly. My mom went to board the flight yesterday and Air India declined to check her in or issue boarding pass and told her that she needs to show extension approval letter. She went back home :-( Now, my question is how do I get a copy of extension approval letter? The above post talks about G_639 and when I called USCIS officer, he told me to file I-824. But, the problem with I-824 is that the estimated process time is 3 months. I want my mom to come in summer time so, that would be too long of a time to wait. Is there any quicker process? Please let me know your comments/suggestions/experiences.

                Naren24, you didn't post to say if you got the copy of extension approval notice or not. Please let me know if going through G_639 worked for you and if you would recommend that process?
