  • Time to process visitor visa extension

    Hi everybody

    I extended my visa from 1.5 months ago. I want to know how much time to process my visa extension. Because it expires on 6th, July. Do i need to come back my country before that day? ( If they haven't process my visa extension yet )

    it takes 3-4 months , so I strongly advise you to leave for home before July 6th.

    Because if it is a denial of extension received after July 6th, your visa can be at risk.

    USCIS says that once you have lived past your original date and you receive a denial of extension , your visa will become void.
    But Customs ( CBP) says if you leave immediately after receiving denial , your visa is not void.

    This is a doubtful area . so to avoid any problems with future entries, leave before July 6th.

      I am planning to apply for visa extension for my Mom who has been in US for the past 4 months on B2 visa. I keep reading conflicting information that the 10 year visa is voided, if the extension is denied. Is that true? What I fail to understand is there is no question of overstay as long as there is a pending visa application with USCIS. At the same time, I do understand that if extension is denied, she will need to leave ASAP. So where is that she is staying illegally and what is the violation to cause the 10 year visa to be voided? Any help with this would be much appreciated.

      Are there instances where one's visa extension was denied and they were able to get into in US in future without having any effect on their 10 year visa?

        Like I mentioned before , this is a controversial area. If you read a USCIS pdf document


        it clearly states in the end, that if extension is denied past your original stay, your visa is voided.
        But I have read several posts where people have been re-admitted by CBP if they left asap on denial.

          Thank you Peace999. From what it sounds, it is a gray area. It is in one best interests to avoid such situations and not apply for extension. I wish USCIS enforce their own rules more systematically than leave folks no clarity on how the rule is applied.

              my personal experience it will take about 2.5 to 3 months to get the reply back from USCIS. If your application is approved you good from the day of your I94 expiration in case of denial you need to leave country as soon as possible n keep your application and other USCIS communication documents stuff safe for your next trip to show at the POE

                visitor visa extension for mom

                Hello,


                I read the previouse posts and again, let me explain my case.....My mother came on April 4th, 2014 has been here till now.....We are planning to apply for an extension and her I94 expires on Oct 3rd, 2014....We are short of 45 days as mentioned in the website.....Is it safe to apply for an extension or rather not apply? I am unable to decide reading a lot of posts...Need some light on this....

                  if you will apply now , you will surely NOT get a response before her last date . I suggest , if it is nothing urgent for her to stay more, save your $ 290.00.
                  Let her leave before oct 3, and return later.
