  • Rentry into US after visa extension

    Hi,

My parents were in the US from Oct 2013 to April 2014 when I filed an extension for 3 more months. My parents left US at the end of Aug 2014. This makes their stay in the US 9 months in total.
Due to personal reasons, I want to bring my parents again to the US in Jan 2015. By Jan, it will only be 4 months since they left US.

    1. Is there any law that prohibits them from coming into US before 6 months? especially since we filed an extension last time
    2. Is there a chance that the immigration officer stamps the i-94 for less than 6 months stay in US?
    3. What other issues can my parents run into in the future

I would appreciate if someone with similar experience or a lawyer could answer these questions.

It's better to spend equal amount of time in home country which they spent in the USA last time, before entering again, especially after the extension.

I'm not saying that they will surely deny them at POE, but they may not allow them to stay for another six months.

Anyways, the frequent visits and long stays will give negative effect on B visas while renewal, after expiration of current visa.

This is my opinion not a legal advice.

My in-laws are in a similar situation. They stayed from May 2013 to Nov 2013 and then we extended for 3 months. They went to India in Feb 2014. They are visiting us again next week. Hopefully, there will be no issues at the port of entry.

One question - I cannot locate thier I-539 (visa extension) approval form. Is there any way I can print it online, so my in-laws can carry it with them? When I check the online status, it only says that it is approved but there is no name or anything. I don't have the time to call USCIS and ask them to send another copy.
