Hi,
I have one question. I came to USA on H1-B from company A and my wife & son came on H4 at same time. Our visa ended (h1 and h4) in Sep-14 however we got new visa (h1 and h4) as I joined new company B who sponsored my h1.
My wife applied for H1B visa from one of the consultancy who was ready to sponsor her new H1B visa.
After applying we got RFE on her case, we have responded to RFE in Aug however no update so far.
My wife is planning to go to India for 2-3 months. So my question is
1. Is it fine to go to India when H1-B is applied and we have received RFE.
2. If H1B is still in pending after 2-3 months (which is not expected) or H1B get rejected, can she come on H4 after stamping it (we have to go for h4 stamping as old visa is expired)
3. If H1B get approved. Can we come on H4 or do we need to stamp on H1 only.
