  • Visitor Visa Extension for Childbirth

    Hello,

My cousin who is a British citizen would like to come to the USA to have her child at my home. Since traveler's visa only last for 90 days, would it be possible for her to come to the USA and then request for an extension or apply for a B2 visa from here?

    Some more info/questions:

She would like to come at the end of June; the due date is sometime in August.
Hospital bills are a non-issue because everything will be paid out-of-pocket.

Also, would an extension or having a child here bar/impair future entry into the USA.

    Thanks for the help.

VWP is not renewable past the 90 days. B2 visas for VWP-eligibles are very hard to come by; a majority are rejected, and rejection leads to VWP privileges being taken away for a period of time.

There's a recent thread where an applicant's visa was rejected\cancelled because his wife came to the US on a tourist visa and gave birth, despite him claiming to have paid all medical bills out of pocket.

*Although not illegal, travelling to the US specifically for routine childbirth is ill-advised.

It is pretty much impossible to adjust status on the visa waiver program.

Traveling to the USA for the purposes of childbirth is completely legitimate and legal, but it is unpopular.

Your best bet is to go on the VWP. 90 days is plenty of time to have the baby, recover, and process all the visa/passport issues and still leave.

U.S. diplomats returning to the USA only get 13 weeks (3 months) of family medical leave act to do this themselves, so it will be extra work to convince a visa officer you need more time.
