  • Visa extension rejection does not void 10 yr visa - Here is the article to prove it

If a stay extension is filed while here on visitor visa and the extension is rejected, this does not automatically void the 10 yr visa that you hold. Here is the article on this.

You should however leave the US within reasonable time after you receive the denial letter. Reasonable time is usually considered to be within 30 days.

You have misunderstood what is written there.

What is written there is true and we all very well understand that and it is well documented on immihelp.com

It just talks about extension filed and granted. Obviously, as long as your extension application is pending, your stay is authorized. However, if it is denied, your stay immediately becomes unauthorized even if you leave same day. And that precisely voids the visa.

There is no rule of 30 days grace period. Where did you come up with that from?

Rejection of Visa extension will void the B2 visa if you stayed beyond your original I-94 date waiting for decision from USCIS

These tips can help you find what you are looking for: Check the URL (web address) for proper spelling and completeness; Use our

Details from page 2 of the above link
Once your original nonimmigrant status expires, even though you generally will be allowed to remain in the U.S. while your extension of stay application is pending. You will not be deemed to be in any nonimmigrant status until such time as we may approve your
extension of stay. If your application for extension is denied after your previously
approved stay has already expired and while you are still in the U.S., you will be considered to have been “out of status” as of the date your period of stay expired, and will be required to cease employment (if such employment was authorized) and depart from
the U.S. immediately upon denial of your application. In addition, any nonimmigrant visa in your passport granted in connection with such classification becomes void at the end of the period of authorized stay. Once your visa is void, you will be required to submit any
new visa application at a U.S. consulate in your home country (not a third country, except in rare instances as determined by the State Department).

Need clarification on "void" clause for extension request rejection.....

So if you get the visa extension request rejected before your 6 month approved stay, then your 10 yr multiple entry visa does not become void , right ?

It was very difficult to get my mom-in-laws 10 yr multiple entry visa. She still has 2.5 months on it and we were planning to apply for an extension of the visitor's visa. We are confused with the "void" clause about the 10 yr visa if the extension is rejected.

Does the 10 yr visitors visa get voided for all visitor's visa extension requests that get rejected or is it only if you are "out of status" by the time extension request's rejection comes thru ?

Someone with experience of this please respond with advice.

          thanks in advance

          Deepak

If the extension approval comes before the the first I 94 expiry, any multiple entry visa issued is valid.
