  • B2 extension and few queries

    My Mom is here in USA and have i 94 till May 10 and my dad will join us in early April. I recently signed a home and closing date is going to be around May 30. I want my parents to be here until Jun 15 to do house warming. My queries are:

    1. Is this a valid reason i can document in letter and provide all necessary documents to USCIS with my I 539.
    2. If the extension is APPROVED after Jun 15 after they left USA will there be any consequences, does she need to be in USA until we hear back from USCIS.
    3. If the extension is DENIED after Jun 15 after they left USA will there be any consequences on her future visits, she can barely speak/understand English so i dont to want jeopardize her future visits.
    4. If the extension is DENIED after she left will her multiple entry visa becomes void.

    This is her 4th time visiting we never applied for her extension and we were not planning to do this time. Its just things happened suddenly without any planning.

    I am not sure whether this is a good reason or not, because it might sound like they are going to help you move, which would be unauthorized work.

    "Consequences" is too vague; future visa decisions and future entry decisions are at the discretion of the officer and it's never possible to predict what they will consider. We can only consider the legal consequences, namely, whether it will void the visa.

    If they leave while the application is pending, there is no effect on the visa. If the application is approved, there is also no effect on the visa. If the application is denied while they are still here, and their I-94 has expired, then yes, it will void their visa.

    Extension of status applications usually take 3-5 months these days. So if they apply in late April or early May, the application will almost certainly be still pending by the time they leave in mid-June, and therefore they don't have to worry about a denial while they are still here.
