  • Visitor Visa Extension due to medical reasons --- Please Help...very urgent

    Hi,

My parents are visiting us and their I-94 expires in one week (on Oct 30th). They were planning on leaving on Oct 29th. But my father got admitted into Emergency room this morning and is scheduled to undergo emergency surgery tomorrow. His doctor has advised him not to travel for another 3 weeks as he requires total bed rest.

    1. Can we apply for visa extension now ( now that we only have one week left before their I-94 expires).

    2. What is the procedure to do that (should we follow normal extension procedure -- applying for I-539).

    3. What type of financial support documents should we provide along with I-539.

    4. What happens if the extension gets denied and he is not in the position to travel. I have heard that if the extension application is denied, we have to leave immeditely.

    5. If we get our airline tickets extended, we don't have time to get paper tickets. Is it ok to provide e-tickets in this case.

    6. Will this extension for medical reasons cause any problem for their future travels.

Please help. Any help is appreciated.

.Apply rightaway before the I-94 expires. Use the normal I539 with
evidence of medical emergency (letter from the hospital/doctor
describing the date and nature of the problem). Provide a copy of any travel health insurance he has (from INdia or from US).Most likely , the extension will be granted since it is a genuine case. But he must keep copies of the current I-94, the extension application and the extension approval notice to convince the officer at future entries to US, in case there are any problems.
You do not need to provide a copy of the extended return ticket as you do not know when he will be ready to leave.
