I am an american citizen by birth, moved to S Africa and got married in Sept 2005
My wife and her two children got 10 yr visas
We came in may 2006 to visit my ailing father who then died in August. We applied for an extension to be with my ailing mother. The original visas expired nov 21 2006
We applied for extension in early October and sent in the original I-94s
and much much more documentation. Death certificate and such
We also had a fee waiver request for whatever that is worth [maybe that caused all this]
WE did receive a receipt for our certfied mail delivery to them. We never received the other receipt though which we didn't even know about.
after reading of long waits for applications to be processed, and long delays for others we thought we were fine and legally here and we were patient.
And we thought on applying we could legally now stay , at least until we heard back anyway.
TIME FLYS
Now in 3 weeks [march 11 ] we are leaving as planned. They say that my wife's and children's applications are not in the system though !!, and that we could of sent them anything in that certified mail correspondence. it is unbelievable, but in truth I can believe it
The original I-94 are apparently lost now
We do not want to jeophadize our future visits to the US. I certainly can not leave my family in S Africa and come here alone if my mother were to die, or something.
Now it will look as though they overstayed their visas
Some questions, and if there is an attorney out there let me know
What should we do before we leave to to ease future damage and make things easy if we return on a visit in a year or so.
If next year from S Africa we applied for immigration would this affect it.
My daughter wants to come to a church camp in July 2007. Would she be let in the country?
Anyway I just wanted to start this thread and hope for help
