    Hi,

    My moms I-94 expires on Sep 3, 2007. I have an important family function planned on Sep 29 and would want her to stay. I am planning to apply for an extension of stay for her. I have following questions though.

    What happens to her 10 year multiple entry visa in the each of the following scenarios

    1. I file for extn of stay 45 days before Sep 3. My mom continues to stays beyond her I-94 date and leaves US on Oct 8. No response is received from USCIS before she leaves US. Is her visa still valid for next visit?


    2. I file for extn of stay 45 days before Sep 3. My mom continues to stays beyond her I-94 date and leaves US on Oct 8. A couple of weeks after she leaves US, I get a denial notice for extension. Is her visa still valid for next visit?

    it is legal for her to stay till she gets the acceptance/denial status. Her 10yrs visa will remain the same.

    I would suggest to keep all the documents related to her extention and whatever response you get from USCIS. Dont loose it, if there is any prolbem at the POE you can show them that you dint have the intetion to stay beyond the requested extention.

      What if after my mother leaves USA and some time later they get a denial. Does the visa still remain valid for the next visit?
