visitor visa (B2) extension got denied

  • visitor visa (B2) extension got denied

    My mom's visitor visa extension got denied and it has been 2 months she overstayed.She have a 10yr multiple entry visa. I heard that the visa will be cancelled if the extension is denied and that we have to apply all over again. Could anybody tell me how far it is true.If it is true how should i contact the USCIS to retain the visa.. Please help me...am really very worried about this.

    Also tell me within how many days she should leave US and what are the documents or the reasons for the stay to been shown at the immigration..so that there shall not be anyproblem for her future visits. My mother doesnt understand english..am afraid whether this would be a problem as she shall not be able to convince the officer.

    Please help me.....

    1. Visa is void now. This has been discussed hundred times before on this forum.
    There is nothing USCIS can do about it.

    2. There is no grace period. She should immediately.

    She will need new visa before coming to US again.

      This is the latest rule passed by the immihelp office regarding section 212

      It says that the 10 yr multiple visa is not void, if we applied for visa extension before the I94 expires and that itself says that it is not illegal to stay until we get the final decision whether it is either approval or denial.

      I think immihelp did not update the information....

        It is not what you are understanding.

        You are misunderstanding what you are reading in that.

        All it says that as long as you apply for extension before current I-94 expires, you are in legal status until you get your approval or denial. And we all know that for years.

        However, once you get your denial and if you are still in US, you are out of status at that moment and that is what voids visa.

        If your extension is approved or if you leave US before decision is made, even if your I-94 is expired at that time, you will have been in legal status all the time in US and visa will remain valid.

          I highly recommend you contact an immigration attorney - TODAY!

          Explain your situation with the PDF document.

          Also from a untraceable pay phone, with no surveillance cameras around, far from where you live, make a call to the local INS office and explain the situation and find out what the options are.

          Sorry for being blunt - but you should have known better than to risk something like this.
